Your interpretation of the rules would force referees to base their decisions on the degree to which the opposing player gets out of the way of a foul. That's nuts. What Torres did could have legitimately broken the guy's leg. Just because he was able to partially get out of the way means it isn't a red? I think the throwing a punch example is apt as well.
I also don't think it's accurate to say there was no contact. I think he caught him on the shin, as shown at 1:05 here.
