I don't think private drones are commonplace at all. But with technology and the internet, it could well be here soon. Outlawing the concept while its in infancy will discourage what might otherwise be getting a lot of R&D over the coming years. I don't see the government wasting big dollars spying on individuals 'just because' being the big threat...I see some guy down the block with a drone watching my wife with a kit he bought on the internet as the threat. Deciding what to ban is definitely the tricky part.
You know, I'd like a little proof before I start buying the notion that someone has a private arsenal of private drones out there. First if true UFO sighting would skyrocket anywhere they were deployed as half drunk people would think they're seeing aliens. Can you imagine Bourbon St in New Orleans, a place where many a private investigator would presumably be operating trying to catch cheating spouses or whatnot, having a drone fly overhead a 3AM?. The FBI would be flooded with calls from people trying to connect with Mulder and Sculley.
Next, while shooting them down would be nice, I'm not sure we want the good people of "flyover country" blasting off Howitzers whenever they think they're being spied on. As bullets don't have names on them, the chances of an accidental tragedy go up exponentially.
