The point I've been making is that the border guard will be and needs to be adequately judged by US courts as is standard in the US. The kid did not get that same 'innocence until proven guilty' judgement...that's the problem.

rather be judged by 12 than buried by 6... or did innocent until proven guilty not apply to the officer when the kid rendered his verdict? That is the specific verdict of throwing rocks at the officer. What right does he have to be judge and jury?

We have self-defense law for a reason

Once the two parties are facing off, the man with the gun makes the decision of whether to kill the other party. The only question is whether the bullet came from his gun...and then based on US law, 'responsibility' is beyond debate.

The question of whether he's convicted comes down to whether its self defense or not.

Interesting comment since you seem to have already tried and convicted the cop.

Where did I say convict the cop? Post?

I don't think it's much of a question whether the cop will be convicted. Border guards have been found guilty for much less.

the general problem, and this extends to Israel and a slew of other scenarios... people forget that 1) people are people, 2) are just as human as they are, 3) the world is a lot less perfect than one envisions it.

We end up forcing an ideal of perfection without knowing what's going on (which is why I've given Obama a general pass on the oil spill though I'm starting to get annoyed with the idea that there hasn't been much of a pretense of any advisory committees on this issue... I don't expect a solution but I expect talk and work)... we believe that we should be able to thread that perfect needle... nobody gets killed... nobody gets harmed... no accidents happen... good people should be able to avoid situations that involve death... so on. Worse is we often then impugn the worst onto people... the usual line of "we have to stop those monsters". The usual amnesty line is along the lines of "we need to save these people" but there's also a string of "we have to save them from these people from harm from the nativist stupid morons".

I'm not targeting this at you, Brent... I know you know that... but its frustrating to see this stuff go on. Just because the perfect doesn't happen doesn't mean that the person is evil, bad, or even misguided. Does anybody here think this guy's going around thinking "I'm going to drop one of them brown looking kids today"? He probably just wants to do something good (best case) and get home at the end of the day to the wife/kids or buddies.

The incident was considered impossible and therefore divinely inspired to the extent its made it down over 3000 years. The fact that it has been considered a near miracle doesn't help your case.

In 5's defense, if you check a rock at me I'd be more likely to fire my gun into the air first than at your head.

That said I agree in general with the counter-arguments to his position.
