Illegal Immigration Pt. III: It's Illegal to be Illegal? Really?

You know how bank executives were probably laughing themselves to sleep after the bonuses they were able to get after recieving bailout money? You know how joyous they must have felt when they realized that the government would inexplicably play into their hands?

Illegal aliens are probably feeling the same way right now.

Re: Illegal Immigration Pt. III: It's Illegal to be Illegal? Really?

A Clinton appointee. Who'd a thunk it? Let me see if I've got this right: the judge has ruled against the part of Arizona's law that requires legal aliens to carry their green cards, despite the fact that the federal law, as I understand it, requires the same thing. huh?

I'm hoping now that the Obama administration has smashed Arizona for interferring with its efforts to increase Latino votes come November, it will now take on so-called sanctuary cities, which ostentatiously refuse to enforce the federal law. I'm guessing this will be a priority about as high as enforcing the Voting Rights Act against the NBPP. Zero.

This could make things even more difficult politically for the Dems, at least short term, as this ruling will give the supporters of illegals some feeling of reprieve (admittedly likely limited), while supporters of SB1070 and such will just be even more outraged that the system has failed them on yet another level.

I've heard, though I haven't seen specific proof, that the husband of the judge in the case used to be the head of the Democratic Party in Arizona. She was also appointed by Rose Mofford, a former Democratic governor of Arizona, to the Arizona bench. I've read some good reviews of her also, so I guess people will put stock in the perspective that fits their agenda.

Not that I'm in favor of the santcuary cities, but it's not their job to enforce the federal law. No city really does, in fact, at most there's co-operation where there's dual jurisdiction and a gentleman's agreement to help one another when asked.

Generally speaking, sanctuary cities are just being publicity whores for doing what every other city does and describing it in a way that's somewhat misleading. The only thing that might be substantively different is their unwillingness to pass along information. Which is a dickish move, but really not an illegal one.

It's really no different than medicinal marijuana cities. The feds, if they chose, could go in and arrest every pothead in every one of those states.

Re: Illegal Immigration Pt. III: It's Illegal to be Illegal? Really?

In a sign of the international interest in the law, about 100 protesters in Mexico City who had gathered in front of the U.S. Embassy broke into cheers when speakers told them about the federal judge's ruling. The demonstrators had been monitoring the news on a laptop computer on the stage.

The crowed clapped and started chanting, "Migrants, hang on, the people are rising up!"

What the heck does that even mean?

No, just to circumvent it. Circumvention = fine, Enhancement = GTFO.

Likely true to an extent - federal judges other than magistrates are pure political appointees. To get a job, you have to have political connections.

That said, most federal judges, even the ones I disagree with, are normally the best legal minds in this country.

Yep. Welcome to modern separation of powers 101. The feds cannot compel the states to do their bidding for them on the states' turf, but likewise can prevent the states from assisting on the fed's turf when they don't want it.

Re: Illegal Immigration Pt. III: It's Illegal to be Illegal? Really?

Despite shafting Arizona, at least the judge admitted there are massive problems, as in the summary section she starts out with "Against a backdrop of rampant illegal immigration, escalating drug and human trafficking crimes, and serious public safety concerns, the Arizona Legislature enacted a set
of statutes and statutory amendments in the form of Senate Bill 1070." Obama can't be happy with the judge pointing out how bad things are on the border, even if he got the ruling he wants.

I guess this is one of those moments when you just have to realize that the federal government is not only inept, but is actively working against the welfare of the state of Arizona and that we are, literally, on our own to deal with our problems, and the feds are in many ways a bigger problem than the events in the border region.

After you drown your self pity with a glass of whatever it is you drink, please keep in mind Arizona can still enforce its criminal code within its borders. You can pay for more cops, more prosecutors, more jails. Hell, just have the state use its eminant domain powers to acquire a 20-foot-wide strip of land right along the border and build its own wall.

The Feds have said they won't help. Well, now you know. So stop looking for solutions that involve them and start using the powers the states still have.

And therefore, when you have a federal government that doesn't want to do anything, you have a lawless state.

Sleep tight, America.

And they will, right now is the whining portion of the program ;) They will win in the end, perhaps not with this law but some other way, this is just the first act of the play.

I have said it before and I will say it again...wouldnt it be nice if the US had some sort of National Guard that could help out here?

I think the Guard is in Iraq and Afghanistan aren't they? How many troops are available?

I'm pretty sure that was his point.

BTW, 2008 data.

Hell, just have the state use its eminant domain powers to acquire a 20-foot-wide strip of land right along the border and build its own wall.

They'd need walls on the state borders, too, and there's no way that's legal.

I don't drink. :p :p

If you didn't notice, we just had our local law stopped in its tracks, so no, we can't just enforce our local laws. The meddling feds aren't going to let us. As I said, not only are they incompetent, they are downright bent on making things worse in Arizona. The feds aren't part of the solution, they are fast becoming part, probably the worst part, of the problem. A good chunk of the state budget already goes for all this stuff, when it shouldn't have to to begin with. Napolitano, when she was governor, regularly sent bills to the feds to pay (none ever were). Now she sticks her head in the Beltway sand and pretends everything is magically better, when it's actually getting worse.

Yes, the United States is approaching failed state status more and more each day.

We won't win in the end. This is part and parcel of the decline and fall of the United States. In the end we're just fighting a bit of a rearguard action. But, sometimes you just do the right thing, even if you know you're fighting a losing battle.

William F. Buckley defined conservatism at its best as "standing athwart history, yelling Stop, at a time when no one is inclined to do so, or to have much patience with those who so urge it."

I always liked that. It's too bad conservatism in practice is rarely, if ever, at its best.
