If Nicastro had forced her to a location against her will, he would also be facing kidnapping charge.

I don't know him and don't doubt anything you're saying. I still think he should have completed the year at BU. If he wasn't going to be academically eligible...shame on him.

And I still agree with this... make the decision to leave at the end of the year... heck it was only another 12 weeks or so.

It's never been proven that there weren't multiple sex attacks against nuns happening in that car when it was hit by a T. Also, I'm not usually a conspiracy theorist, but if you take the name "Nicastro", and sub in "Eaves" for the first 5 letters and then delete the "tro" you get "Eaves". Freaky stuff. This will all be a Nick Cage movie one day and all the BC trolls will get what's coming to them.

I'm not an attorney, but I've worked in law firms, and know lawyers well. Generally, you negotiate and plead guilty to a lesser charge. Except in high-profile cases, both sides would rather see things done quickly. There are a few reasons why lawyers don't want to go to trial. If you want to know why, I can go into more detail.

Not sure if TBA is criminal defense attorney, so I don't know where he stands.

I think you guys are overthinking what I'm saying. Let's just take lawyers, etc. out of this and focus on the criminal. This person is so upset with what they've done that they think they deserve the maximum punishment...and therefore want to plead guilty. I just can't call that person an "idiot" for that reason.

Let me take your position and re-phrase it. The person is so upset with what they have done, the person pleads guilty and shows significant remorse to the court and the victim in order to receive the least amount of punishment. I don't call this person an idiot either. I may be far, too, naive about the way in which the legal system actually functions.

According to the articles from today, it was apparent that he was going to go back home to California until his next court date, so he probably took a leave of absence from school pending the charges. FWIW, as of now, he's still listed on the online roster.

I'm pretty sure BC has already been mentioned in a movie. I think it was called "Goodfellas"....

Don't care about the legalese involved, but as Fidel was arrested he can't be on campus in any way, shape, or form. Send his tutor over to class to take notes or whatever, but he doesn't belong at school. If this is all a misunderstanding then the school can send its profuse apologies but better safe than sorry.

I can see that... but won't he see a lot of that extracuricular nonsense in the Q too? Kudos to him as a person if he is steering clear of the over partying scene.

The money figure has NEVER EVER been substantiated... As for extracuricular activities in the Q..Of course it happens it happens at ALL levels of hockey as anyone who plays or has played competitively knows that (and it goes for most sports as well) ... However the HUGE difference is that in the Q you live with a Billet family...a family that becomes like your own...you are taken care of..you play with and watch their kids...you become part of their family. So essentially if you want to be a homebody and just work out and just play hockey you can..and its acceptable...

To make it more simple, I'll say this: There is a 0 percent chance he pleads guilty to rape. But he can plead guilty to a lesser charge -- like assault or something -- and serve less time. It's like playing "let's make a deal." both defense and prosecution would rather take the smaller cash prize in exchange for not having to open door number three.

Note: I really don't want to trivialize this serious subject, but I was trying to explain the real-life practices of the judicial system. And no, I'm only taking the PROCESS lightly, not the charges.

Now, a question: will he be able to finish the semester class-wise? I understand not wanting to have him on campus. However, should he (or anyone, really) be found not guilty of a serious crime (and I mean honest-to-god innocent and not just off on a technicality), would (s)he have to re-take the semester? I can see that being trouble, but not common.

Sorry, I now get what you're saying. If he knows he's guilty and wants to admit it, he's more likely to try a "no contest" plea, which is basically throwing yourself at the mercy of the court. There's also an Alford plea, which is sorta different. But it is rare to plead guilty to the main, harshest charge thrown at you.

ETA: Like buying a car, only stupid people pay sticker price. There's always wiggle room. After all, any lawyer will tell you, "the guilt you feel now may not be there when you're 5 years in to a 25 year sentence. Better to serve less time, and repent later."

If I was the AD I would recognize that Parker's strengths inevitably create weaknesses and I'd expect the staff selected to compensate for those weaknesses. If Parker didn't see it that way, that is the conversation I would have had back when Quinn left.

Well said. I will not be surprised if this incident is the final straw and JP bows out and Quinn comes back. Jack IS horrified about what happened with Max. This is just one too many incidents in one season not to be having that conversation internally.

I am a lawyer, but never did any criminal work other than some minor cases many, many years ago. However as the need for the young woman who is the victim having to testify:

This is a serious felony and the DA could chose to present evidence to a grand jury and if the grand jury indicted the defendant would then be arraigned on the indictment. The young woman who is the victim victim would testify before the grand jury but these are closed sessions, no counsel present and obviously no public present. Because of this the victim might have to testify first before the grand jury and again at trial. Only at trial would she have to testify in public and face cross examination.

Wow, cant believe what this escalated into. 20years in prison? That kid's life is potentially over...., law and order svu status. Im not even thinking about the hockey anymore, this is just real real sad.

any reporting done talking to the office of the president? any word from university leaders on how they are looking into what is going on here? or are they asking for tickets to the ncaa tournament?
