I believe the process is at the arraignment, Nicastro's lawyer will likely ask for a probable cause hearing, and this is where it would be determined if there's enough evidence to move forward. I suppose that could happen at arraignment, but in the unlikely event this is overblown beyond proportion, I wouldn't expect the judge to kick it at his arraignment. I don't know when a police report would become available through an FOI request.

I remember when Eldeman was arrested the globe had it online the next day. Granted that was with the Boston Police Department not BUPD however I would assume BUPD would have to get it done soon as well.

It most certainly will, but the percentages seem to indicate that when push comes to shove, the victim won't pursue this to the fullest.

I hope she does, and I also hope she has a strong means of emotional support (family, friends, etc.). No doubt his lawyers will try to attack her credibility if this ever goes to trial. It is the price we pay for due process, but it sucks so badly that victims have to go through it for justice.

Look, there needs to be an open investigation here. If the anonymous Internet reports of widespread, unreported sexual harassment and assault are true, then students, alumni, and the community have a right to know who knew what and when. If these incidents happened on campus, in University housing, were they reported to RAs? To staff? To the dean's office or to the ahletic department / coaches? These are the relevent questions, beyond Nicastro's individual guilt or innocence and the (of course, most importantly) the impact to the victim.

If there were no reports / complaints from the housing staff to the athletic department/coaches, and no players reported on bad behavior, then it is a University issue, and it needs to be dealt with on that level.

If Parker/coaches knew about a culture of harassment in thr dorm and did nothing, then they should resign.

Oh Carmine, you have to look at all the facts. The fact that she let him in two more times after the first time she claimed he broke in makes her credibility on this issue less than pristine. When a guy breaks in to your place, do you let the burglar in a couple of more times before calling the cops? Not really.

This is what they tried to bait me into saying last night. Now you'll probably get skewered for "blaming the victim."

If you had a job and a girlfriend you would spend less time worrying about me. You do realize that, right?

As far as the team goes, I think there is something to be said for "we're all in this together". If a player is out of control, his teammates need to elevate it. BU should waive an invite to the NCAA's this year to teach these kids that there's consequences to bad behavior.

This isn't law school, it's not cut and dried. There is a jury. They will find her credibility on the B+E highly suspect. It seems like an implied consent defense.

When an accuser falsely cites non-existent policies as reasoning for her actions in a key component of the incident, that makes it reasonable to question the accuser as to why she made such false claims. It does not make it reasonable to say did you really get assaulted, or come on, you were asking for it, but when you're making serious claims against someone and use falsehoods to back up part of your claim, you open yourself to be reasonably questioned on those falsehoods. Are you sure you're not Mike Nifong?

So once he is let into her room once at any time in the past that means he can break in at any point in the future to sexually assault her and she is kind of consenting?

When an accuser falsely cites non-existent policies as reasoning for her actions in a key component of the incident, that makes it reasonable to question the accuser as to why she made such false claims. It does not make it reasonable to say did you really get assaulted, or come on, you were asking for it, but when you're making serious claims against someone and use falsehoods to back up part of your claim, you open yourself to be reasonably questioned on those falsehoods. I don't think it is a false claim, seems like she honestly believed it was a rule.

He still broke in uninvited it would seem and sexually asaulted her, so the facts of the case remain the same.

You don't think she believed that, but you don't know. No one knows whether she truly believed it or not, hence why it's reasonable to question why such claims were made, and whether she really honestly believed she was required to open her door, or if she opened it willingly and subsequently changed her story after the fact.

one doesn't need to break anything. if i go see mav and he opens the door and stands there and talks to be, but doesn't invite me in and just stands there - i am not able on my own to just walk through him or past him. if i do, that's b/e. when they make laws they don't write b/e, almost b/e, kinda b/e, sorta but not really b/e.

if there is an open window, can i just climb through? i'm not breaking anything...

Hey, aside from the sad realities of the case which should be front and center, I will admit there is some entertaining trolling material from a BC angle. However, this discussion about the minutiae of what constitutes Trivino breaking and entering is getting pretty boring. If you guys are going to troll at least step it up! :)

Obviously Max is innocent if Corey was. She opened the door! Tomorrow after arraignment we have another girl's credibility to question. Exciting!

What if the RD told her this was a policy (due to RAs in the past not answering their doors for whatever reason)? If the RD overstated the importance of her opening the door during summer training, is she still a liar? Just positing.
