I wouldn't. It's a sad fact that we don't know how many sexual crimes go unreported. I've known many girls who have not come forward with reporting for a number of reasons: embarrassment, shame, fear of scrutiny, fear of having their sexual history put on trial. (note: to my knowledge, no one I know had an incident with any athlete at any school.)

It is "simple math" if 2 of the 5 incidents of reported sexual assaults involve students who happen to play hockey for the university. I don't like the idea of having BU not accept a bid to the NCAA tournament because it would punish the players who are responsible human beings; innocent until proven guilty. Collective punishment is nothing more than communism.

Here's a simple math solution: Send the #7 to heaven.

Sound's crazy, I know. The #7 should be unceremoniously retired and should be used as an example to all current and future players that this kind of behavior is unacceptable behavior for any person in society.

Don't hang it from the rafters of course. The BU Hockey public relations folks don't even need to let the public know that they retired the #7. We will all know that the number has been retired when we don't see any more #7's skating for BU.

Simple math.

Well, in terms of legality, for breaking and entering he almost has implied consent to enter, then came in several times before she called the cops. So I feel that for breaking and entering they might have trouble proving that.

This is all I was bringing up. If he were not charged with breaking and entering, this story wouldn't be all that relevant except to find out if she truly misunderstood the rules or made up a story after the fact.

I didn't read enough to figure out who started that but let's just put an end to it now... This isn't about a hockey rivalry.

Wait, are you implying that someone should send Max Nicastro to heaven, or retire the number? So anyone wearing #7 is automatically a rapist? Would that also mean that anyone who is a defensive coordinator at Penn State is also a child molester?

I was just saying that just because it's a sad fact doesn't mean it's not seriously concerning.

In order to prove the defendant guilty of this offense, the
Commonwealth must prove four things beyond a reasonable doubt:
First: That the defendant broke into a (building) (ship) (vessel)
(vehicle) belonging to another person;
Second: That the defendant entered that (building) (ship) (vessel)
(vehicle);
Third: That the defendant did so with the intent to commit a felony in
that (building) (ship) (vessel) (vehicle); and
Fourth: That this event took place during the nighttime.

As to the first element of the offense, “breaking” has been defined as
exerting physical force, even slight physical force, and thereby forcibly
removing an obstruction and gaining entry.

Misread post, reading through these posts quickly while also trying to get work done in my office and coordinate with UPS to ensure a package doesn't get stolen off my doorstep for the second time in a week, and a partridge in a pear tree.

According to the BU Police Department police report, obtained from Brighton District Court, the incident began when the RA heard individuals of a room being extremely loud. The RA went to the room to tell them to quiet down, and Trivino followed her back to her room and pushed her door open, the report states. She said in the report that she told Trivino to go back to his room, but instead he allegedly started kissing and groping the victim. The victim told Trivino he was being inappropriate and should leave her room, and he left, according to the police report.

A few minutes later, Trivino allegedly returned and was banging on her door. The RA opened the door slightly and Trivino tried to kiss her, but she pushed him away, according to the police report. The RA said in the police report that she told Trivino “You need to stop,” and “You need to go.” Trivino allegedly cornered the victim by her desk and attempted to kiss her as she pushed him away, the police report said. She said in the police report that she managed to get him to leave at that time and she then texted a friend for help.

Trivino then returned a third time and banged loudly on the door, according to the report. The victim said in the report that she needed to open the door as part of her RA duties. Trivino allegedly forced his way in again and tried to kiss her, then sat on her bed, took his shoes off, said he would sleep there that night and laid down.

Correct me if I'm wrong but in a case like this a representative from the ADAs office will present what they have so far in their case to a judge. At that point a judge will decide if there is enough to justify the arrest and send it to a grand jury. Also at this point the press should be able to get a copy of the arrest report through a freedom of information request?

Gotcha. Well, I don't have a kid, so I can't say I would do x or y. But t haven't pressed charges for those I know who have been in the situation.

Like I said, there are reasons these crimes are under reported. Whether or not this girl wanted that spotlight -- I think her father realized it was not HIS call to make. That help?

Bah, I'm tired of all of this. Why are we still talking about Corey?

What concerns me beyond everything else with the exception of the victim herself is how on earth after this happened once the players couldn't look out for each other enough to not let it happen again. Or indeed why the players would even have to do that. I'm not sure what I think it means yet but people that are starting to see a larger institutional problem are on the right track and it's utterly disturbing.

It most certainly will, but the percentages seem to indicate that when push comes to shove, the victim won't pursue this to the fullest.

But she does have the security in knowing she's not exactly "shaking the boat" or stirring up trouble or something. It may be easier for her to come forward now. Frankly, I hope she comes forward and doesn't hold back.

I believe the process is at the arraignment, Nicastro's lawyer will likely ask for a probable cause hearing, and this is where it would be determined if there's enough evidence to move forward. I suppose that could happen at arraignment, but in the unlikely event this is overblown beyond proportion, I wouldn't expect the judge to kick it at his arraignment. I don't know when a police report would become available through an FOI request.

Oh Carmine, you have to look at all the facts. The fact that she let him in two more times after the first time she claimed he broke in makes her credibility on this issue less than pristine. When a guy breaks in to your place, do you let the burglar in a couple of more times before calling the cops? Not really.

This isn't law school, it's not cut and dried. There is a jury. They will find her credibility on the B+E highly suspect. It seems like an implied consent defense.
