how is it possible this is no longer taught in schools? its the bedrock of our judicial system. you can't look at a history of our justice system without knowing this.

are there actually people out there who would like to see it overthrown? (except Foxton, of course)

If you merely read Obama's words, isn't that exactly what he was saying? "how dare the Court overturn a law passed by a 'wide majority'?"

Judicial review? We learned about it (at least in 2002-03). The whole situation, though, reminds me of a blues song I wrote when I was young about how I "never got my way". I wouldn't surprised, though, if FDR gets his 6th te- er if Jimmy Carter gets his 3rd te- er if Obummer gets his 2nd term that he would look to disband these systems and create a dictatorship in order to get his way.

It's not just his side. Conservative pundits felt the same way about the review of Prop 8.

I'll bet you could find similar language used by every partisan for every bill that came before the Court.

This is particularly ironic because the right has used "judicial activism" as a catch phrase which reduced to "don't you dare overturn one of our laws" for decades. To see them suddenly talking in hushed tones about the sanctity of judicial review is funny (as I'm sure it is for cons to see liberals suddenly embracing the sacrosanct will of the legislature).

If you think it's inappropriate for a president to use the bully pulpit to talk about his opinion of a Court's unannounced ruling... yeah, I'm with you on that. But if you think he's really doing anything different than every other president in history, no, I would ascribe that to Baracknaphobia.

No doubt you feel differently about this than I do, but I definitely see a big difference between a Court overturning a law because they could not find an enumerated power that gave Congress that particular authority versus a Court overturning a law because if they squinted juuuuust right they could maybe see that there could be some indications that perhaps there could be an implied right which nobody had ever heard of before but was so important that it needed to be protected.

Using the same term for both cases is pure wordsmanship - the former is an active, vibrant judiciary. The latter is judicial activism.

You and I agree on this, in fact. But the political forces and partisans who are lined up over this are obviously not arguing from that distinction. This battle is pure politics, and Senor Scalia is as much a politician as Komrade Obama.

I have a feeling this particular Court will strike down the law, albeit for purely political reasons, which if nothing else should remind liberals when it's kinda cold on Election Day that elections have consequences.

Meanwhile, the Congressional Black Caucus is offering a resolution that, among other things, condemns George Zimmerman for his alleged "racism" in killing Trayvon Martin. It should be noted, one of the representatives is Alcee Hastings, who used to be a federal judge. Until he was impeached and removed from the bench for corruption. These folks are themselves, racist. As are those who've used their acute powers of diagnosis to assert that "Zimmerman's nose doesn't look broken to me." As usual, they are hewing to the philosphy of: always do your best to make a bad situation worse.

We're stocking up for some camping this summer, so if you hear of any good deals on lighter fluid, please let me know. It makes a huge difference when starting up a fire after one of the monsoon rain storms sweeps through the campsite. Glad to know you're looking out for us Arizona campers.

Forward that to His Constitutionalness, with a possible reference to Marbury vs. Madison. No "emanations from the penumbra" in the pending mercy killing of Obamacare.

We tend to go camping to get away from all such unpleasantness and nonsense. So, no weenie roast for Weiner at our campsite.

I know I shouldn't touch your posts with a 10-ft pole, but technically Roe v Wade simply struck down some Texas laws as unconstitutional because they violated individuals' constitutional rights to privacy. That IS their job, no?
