Well, I guess all I can say is I hope you've never done it while intoxicated, because then you were raped and mostly likely you raped your partner, too.

He was 19. I cannot think of a single male who, at 19, wouldn't say "YES" to a girl who claimed she was 17 and obviously wanted to do the deed. (16 is age of consent in MI, if both parties are under 21 - Catholic school taught me that ;))

It doesn't excuse the fact that, in reality, she was underage. However, can we really expect a 19 year-old mouthbreather to ask for ID? :rolleyes:

I agree, however, that isn't the case in statutory rape, which is unfortunate. Look at all the seniors (18YO) who are dating freshman (14, 15 years old) in high school.

She told him she was 17.

She and her mother testified on his behalf.

This is just some political grandstanding by some herpa-derps and this kid is going to wind up with our age's scarlet letter. Speaking as the father of a daughter, it's total BS.

Many states view statutory rape as a strict liability crime. There's a case in Iowa where the guy literally asked to see her id to make sure she was 18. Turns out it was a fake ID. The state supreme court upheld the conviction, saying all that matters was that she was, in fact, not of age.

I think it's the wrong outcome, but it's one that is not unique to Michigan.

Pretty sure that's the case in MN, too (the showing of the fake ID doesn't matter).

I am sorry but that is ridiculous. The idea of checking ID is sad enough anyways but if they fake it is still my responsibility and not theirs? Gee could we infantilize women any more?

The same situation goes for guys, too. They have to show ID. /sexist ;)

It is ridiculous. Context is always needed in laws like this.

This is where I greatly diverge from the law. That's beyond stupid. And stupid is the right word for it. There was no thought put into it.

There is plenty of thought put into it -- thought about re-election. Mandatory minimums are a tub thumping tactic -- it makes the candidate look "tough on crime" and for "cutting the red tape" for the kind of semi-sentients that appeals to. There's no political way to oppose it because they'll run ads about how you love rapists, etc.

This is one of those times when the species id is stronger than the species brain.

What is next ban movies like Animal House and Revenge of the Nerds for promoting rape? I mean basically those movies are one long date rape based on the modern world!

So lets say I am at a bar on a 21+ night. Girl walks up, buys me a couple drinks (while having one herself) and wants to hook up...do I need to id her? Lets say I do and she has a fake am I still liable? (fyi in Minnesota the bar would not be as long as the fake looked good...yes that is true I take dram shop class every year) Lets say I am drunk and she isnt did she rape me and better question will she be charged?

Stuff like this makes a mockery of real rape/date rape and the true victims. It also makes it super easy to cry rape if you have a bad hook up which in turn discredits true victims.

You're guilty as charged. No matter what you do, you're guilty. If you're near a college campus, not only are you guilty, but you will be sent to reeducation camp.

I know it contravenes biology, but the best bet is to keep it in your pants. You'll be safer in the long run.

It's ironic that the right tries for 50 years to criminalize non-marital sexuality because of their superstitions, and then the left accomplishes it in 5 years in the name of women's rights and public safety.

Which brings up a thought... In some states, you can get married before the age of consent previously described. Is it still rape if you are married and under said age?
