but not under oath ;) in which case they could merely cite their right to remain silent to avoid self-incrimination. And in every jury instruction I've ever heard of, jurors are not supposed to infer anything whatsoever any time a defendant invokes said right.

Key word being incrimination. The fifth amendment only applies in the criminal context. There's no right to remain silent unless criminal charges are in play. If it's purely a civil matter, you can be compelled to talk.

Last I checked, the NFL does not enforce a criminal code. Frankly, they don't even enforce a civil code, they can infer whatever the hell they want from people's silence.

He knows that if this went to a truly neutral arbitrator, chances are this suspension gets overturned entirely. At least with this he can salvage a suspension even if he reduces it to try and please both sides. Now, while the Pats defense yesterday wasn't the greatest rebuttal (still had some good points)...the following is very well done by Brady's defense:

Why does Goodell have to overcomplicate things and create a conflict of interest? Is he really that much of a micro-manager?

It truly is a miracle of collective bargaining that this is any more complicated than (a) NFL has a rule about ball pressure, (b) Brady/NE knowingly broke the rule, (c) Brady/NE get a punishment.

Except that no matter what you believe here, the bottom line is there isn't a shred of evidence linking Tom Brady. Even if you think he's guilty of demanding balls be under 12.5. I don't even care about the penalties handed down on the Patriots as a team. The 4 game suspension of Tom Brady is absurd and I think Goodell knows that if a truly independent arbitrator heard the appeal, there's a very good chance the entire suspension would be thrown out.

That was the TEAM defense of the guy you're talking about. That was not part of Tom Brady's defense. They are absolutely separate in this case.

Get a little more defensive...you obviously care about the Patriots...It is obvious to me that Tom Brady did something wrong, he did not cooperate, which may be the only reason that there "isn't a shred of evidence linking Tom Brady" Covering something up always gets you in more trouble than if you just fess up if caught. This isn't a criminal court, the NFL doesn't have to prove beyond a reasonable doubt, they said as much in the way Wells reported things.

As for the 4 games, its all about setting a tone, you think other teams will be more careful about not attempting to stretch or circumvent rules? You think Cleveland and Atlanta won't be extremely careful knowing they've already been punished and next time will be more harsh?

Not sure how I'm being defensive. I'm being neutral. As I said, don't care about the penalties levied on the Patriots. What is the precedent on not fully cooperating? Is there one? That I don't know. Is this the first time this has come up in a player suspension? What is the language in CBA about not fully cooperating? What is the definition? A player simply has to do whatever is asked of him?

I take it back. The San Diego Chargers did not comply when the league asked for the towels that allegedly had stickum on them. They got a whopping, oh wait, $20K fine. Does that sound like the equivalent of a 4 game suspension?

If you haven't noticed, we live in a very different world than we did in 2012 ;) The stuff with Ray Rice has changed everything...for better or worse.
 
Players association going to call goodell as witness. This is going to be great summer ;)

Brady is getting effed because there's no way they deflated the balls without him being aware since he's the primary beneficiary. Toss in lying...

GLA gets credit for and pushes the idea that he is the hardest working, smartest qb in the business. he is absolutely lying for him to stand there and claim "i just like them soft" and act like he has no say in nor no idea with how they are presented to him on the field at game time.

Eh, not really a fan of that change. I say back it to the 8 and have all plays start there, be it a kick or a 2 point try. From the 8, you're back a little further for a kick, the Defense has a little more territory they need to cover to stop the try, and allows for the special team guys have reasons to keep an assortment of trick plays in their back pocket.
