My first instinct is it doesn't matter, it will go to the Court and just as they did in Bush v. Gore they'll ram it through on purely partisan lines. But. Cruz really is utterly loathed, and he's also perceived within the RNC and a guaranteed loser, so their partisan decision may be to bury him.

My first instinct is that if McCain, who was born in Panama to American parents, was eligible, then so is Cruz. Not that I'm not enjoining the schadenfreude of him being subject to his own birther movement.

IIRC McCain was born in the Canal Zone, American territory at that time.

A US military base isn't a foreign country.

CZ wasn't a base. It was an unincorporated US territory -- one of only a few and the only one anybody without three history PhDs has heard of. This is as distinct from incorporated US territories, of which two rather important examples still exist: Washington DC and Puerto Rico. A territory is unincorporated until an Organic Act is passed for it, which is really just the way Congress establishes the mechanism by how it is governed. Until incorporation, you're on your own.

But your broader point is right on: McCain was born on sovereign United States territory. The question re: Cruz is does "natural born" equal "on sovereign US territory." Here is an argument that says no, "natural born" just means "not naturalized." It has some hedging at the end, and it also mentions an interesting precedent: although unlitigated, it was apparently taken for granted that Mitt Romney's father (born in Mexico) was eligible to run.

I assume from all of this that Cruz is in fact both eligible and an as-hole.

Sure, I agree. But since it's never been litigated the possibility for a suit being filed is there. Cruz is wrong when he says it's settled law. It isn't.

I wouldn't equate the two. The former is an interesting piece of legal minutia which should and hopefully will be settled once and for all by a clear, unanimous Court clarification. The latter was an ugly, cynical partisan tactic that appealed to racism and willful ignorance.

My Dad would say, "we stole it fair and square." :) He felt the same way about the Brits and Hong Kong.

Indiana state Sen. Jim Tomes (R) has proposed a bill that would make it a crime for transgender people to use public sex-specific restrooms that don’t conform to their gender at birth.
What locker room should a TG high school athlete use?

This actually brings up a very interesting question. A large percentage of transgender women (men becoming women) later identify themselves as lesbian. If a transgendered girl, who has not yet had hormone replacement therapy - let alone the operation, and is attracted to women, how does a school handle the body's natural reaction to such a situation? This isn't just an idle speculation on a situation that wouldn't occur either. A lesbian friend of mine used to date a post-op transgendered woman, and some stats were thrown at me about this very situation (minus the high school locker room caveat), and they were substantial.

The impetus behind my question and the motives to Sen. Tomes' bill are likely entirely different (I'm not anti-GLBT), but it's something I never really given much thought. The logistics and implications could be troublesome.

I think I'm on fairly safe ground to predict that most unwanted locker room behaviors are perpetrated by heterosexuals. If you were a TG high schooler, the last thing in the world you would want is to draw even more attention to yourself by misbehaving.

I'm not talking misbehavior on the TG teen's behalf; I was really thinking more about the reactions of the other people in the locker room than the TG teen. Because you're right, that TG teen will try to become as invisible as possible in those situations. Still, being a high school-aged person and the way high school students think (we've all been there), if that pre-op girl happens to see someone, or thinking about someone who's not even there, and her body reacts by giving her an erection, even with no intent of "perversion" on her mind, someone could notice of her reaction if she's not careful and that could create a whole slew of headaches.
