Oh C'mon, nothing is funnier than a Westfield St "grad" with a certification in typewriter repair pretending to be a BC alum with strong ties to their athletic programs. I don't even see any real BC grads who have been out here 24/7 since the story broke. His job and his girlfriend must be getting real upset that they're playing second fiddle to a college hockey message board thread (assuming both of them exist, of course...).

Fine, I'll answer your question before you go. I was happy to see a reasonably thought out post that was, as I said, logical and thoughtful, regardless of which side the poster was coming from. There are points to be made on the opposite end of this argument, against Parker, but ones that are presented reasonably, are not backed by an obvious longstanding bias against him, and don't involve stretching realities and twisting results to fit that narrative, are few and far between around here.

Nicastro ordered held on $10K bail (lowered from $25K) pending probable cause hearing on March 26. Unless facts come out that make it blatantly obvious that this is not a rape, I don't see him playing again this season.

Nicastro's attorney tells court no criminal act was committed.

Thanks for the response, bonanza. Just relax. I think most BU fans have been more critical of Parker for this incident than I have anyway. If you have a problem with something I say, call me out on it. Other than that, at least you're beyond getting into personal lives and launching incessant insults.

I do have one question (maybe TBA can grace us)...

A lot of times, female victims don't go through with a trial. At what point does that typically happen? Is a probable cause hearing usually beyond that point?

Not an attorney, but I'll guess. It would probably depend on the girl. She was not required to be there today, he only was pleading to the charge and setting the next court date. I would imagine her willingness to go through depends on how mentally and emotionally strong she is, the overall validity of her claims, any outside pressures that (wrongly) may arise against her, and the extent to which she'd have to participate in such a trial. Of course, if this does go to trial, she will have to testify since Nicastro has the right to confront his accuser.

Does anyone know what non-conference games (excluding Beanpot) BU has lined up next year?

Fed tweeted that RPI is scheduled to be at Agganis next year.

So we would have: Beanpot, RPI, @UND (for 2???), i'm guessing Harvard at Agganis

Police report was impounded due to sensitive nature of the content, so we probably aren't going to see any details of this unless TMZ decides it wants to pay off someone at BUPD. He was released on bail, ordered not to have contact with the victim. Apparently he will not enter a plea until the PC hearing on 3/26, but you'd have to guess it would be not guilty based on his attorney telling the court that no crime was committed.

Yikes. TWO counts of rape now. I thought it was only a single count of rape going into the day. This is worse than I thought. Did he go back for seconds like Trivino tried to do?

Tough situation for the BU administration to handle. I would think they have to leave him out there in limbo in the current suspended indefinitely status until more details come out unless BU is able to conduct their own investigation (would a court allow this?).

Anyway, this is just a terrible, terrible thing.

Wait, did a 2nd victim come forward to account for the 2nd charge or is this the same girl making two separate charges?

I'm confused by what the question is. She's accused Nicastro of rape, she will have to testify in court. Nicastro has the right under the Confrontation Clause (6th amendment) to face his accuser (to have his attorney cross examine her and try to damage her credibility.) What will happen is if she doesn't want to testify-the case is over.

Are you asking about what stage the alleged victim has to make an appearance? Trial.

He could be the guiltiest man on Earth, and his attorney would tell advise him to say not guilty. Guilty pleas are only for idiots, or plea bargains.

There is no report at this point of a second victim. I'll let the lawyers explain how a second charge could come up, I really don't know.

Each separate act of vaginal intercourse constitutes a count of rape. If they had sex on the bed, then the couch, that's two counts of rape. I'm not sure if forced oral or sodomy are separate charges under Mass. penal code.

Hope that helps you understand how he could be charged twice. The alleged victim could have given her story to the police, and said what happened and then they charged Nicastro with one count, then they went back and read the report and found two counts would be more appropriate of a charge. They go for broke, sometimes.
