It's all about Religious Freedom, right?

You know, it seems like she should be able to sue for slander if she wanted to. Calling someone a prostitute is still "slander per se" in most states. And I don't think a 3rd year law student counts as a public figure, even if she wanted to testify at Congress, which makes it a whole lot easier to win such a suit (don't have to prove willful disregard for the truth, for instance).

I understand that generating outrage is Limbaugh's schtick and all, and any publicity is supposed to be good publicity. But at least two major advertisers pulled their sponsorship today and the backlash got so loud that even Obama could no longer resist jumping on to get his digs in. Did Rush finally go too far? Or is that what he wants us to be asking each other? Or what?

From what little law I studied in college, slander is hard to prove without a vicious case and a sympathetic jury. But you're saying that if she isn't considered a 'public figure' it's easier to win?

I didn't care for Rush's comments, but should a girl attending Georgetown really really be the poster child for the costs of contraception? ;) Maybe she was just speaking for the less affluent...

I thought it was referenced to her needs and I'm sure a 3rd year law student at Georgetown is destitute.

Wasn't the main point she was trying to make that contraception is not just about preventing pregnancy? Wasn't she there to tell the story of a classmate who needed a pill that helped cure some problem and prevent her from becoming infertile?

IIRC she needed it to stop cysts from forming.

I'm a little surprised about the flippancy in some quarters regarding higher gasoline prices, many of those conversations seem only to consider the potential effects on drivers of passenger automobiles.

The national supply chain also runs on liquid hydrocarbon fuel: truck and rail probably carry 95% of the food in this country, truck and air propel FedEx, UPS, DHL, etc. And after truck, rail and air in the supply chain (of physical goods) probably comes barge....

Liquid hydrocarbons also are a key input in the manufacture of certain plastics as well.

The price of just about everything we eat, everything we wear, nearly everything we touch, is affected.

Yeah. There's generally 3 or four elements to prove up. But if the case involves a public figure, you have to prove actual malice and/or "willful disregard for the truth." If it's just an ordinary citizen, then those latter two elements don't need to be proven. Limbaugh could attempt to show they were true as an affirmative defense, but unless this student was an escort on the side to pay tuition ala The West Wing, good luck with that.

Additionally, most states still consider statements impugning the chastity of a person (often limited to unmarried women) or serious sexual misconduct (of which prostitution would surely count) "slander per se" - which means the statement is defamatory on its face and so long as you can prove it was said and disseminated to third parties, you can pretty much win at least nominal damages.

The Republicans should just nominate Limbaugh for prez. Why go only half-way to ***hole with Romney? Run the real thing, then he and Obama can let everything out on the table in debates without having to fight by proxy.
When the dust clears, we can ship them both to Venezuela and find actual leaders.
