So while it has the Power to do so, it is not explicitly required to do so. Legal eagles agree?

How might this Power be interpreted in the 21st century? does this Power in today's world mean that Congress has the power to establish a common centralized email exchange if it wanted to?

Why not? Who's going to stop them?

Can a nominee realistically get confirmed by the GOP Senate?

That's why it will be nuts. I mean, Obama's other ones got through, they weren't super far-left but they will strictly center either. Though I guess there might be more GOPers in the Senate than those times. Usually someone has to be pretty far to the extreme to get straight-up Borked, and there are probably enough moderate Republican to get them through, but with this election year who knows how it will come into play. I look forward to Rubio and Cruz going ape**** during the process. And just the fact it's Scala getting replaced, by commie-nazi Obama of all people. This is going to be nucking futs.

Edit: I thought at least one of Obama's was with a GOP majority, but I guess both were when the Dems were in charge. That said, if the GOP keeps refusing on people and leaves the seat open for too long, do they get blowback?

There's never been an 11 month long stall to nominate a SC judge, but we all know that the Republicans have been setting new "records " since 2010.

Justice Scalia was an American hero. We owe it to him, & the Nation, for the Senate to ensure that the next President names his replacement.

I would think that Obama will have to nominate a centrist if he wants any hope of a confirmation before he's out of the White House.

Edit: Also remember that there are 24 GOP seats and 10 Dem seats up this year, and a lot of those GOP seats are in blue/purple states that won during the 2010 midterms. Could make that interesting too.

Cruz's comments are the opening salvo. Once he's knocked out of the primaries, we'll see the process truly get underway, and at sometime in July or early August we'll see the approval process complete.

Every president has a list of names as potential replacements, and those lists likely varies upon which justice left the court. It's just a matter of convincing the highest rated person on their list (including the probable cannon fodder candidate) to accept the nomination and suffer the confirmation process.

It's funny that they can't see this could cost them the election. I mean, any liberal that has second thoughts about the Dem nominee is now highly more likely to vote now.

All we need is for Cruz to start talking about the type of nominee he'd name. Every woman north of Tennessee will vote (D).

If the GOP blocks the nomination process, they better hope they win in November. Because Obama is likely to nominate a moderate knowing that's all that could get through.

If Hillary or Bernie wins after the GOP holds up the nomination process for a year under the guise of "giving the American people a chance to weigh in," they're gonna get the liberalist lib that ever libbed, and they'll have to confirm.

Is there any precedent for a Senate openly admitting that the confirmation process won't be about the nominee(s), but about who's making the nominations?

I think his finalists are Kim Davis, Roy Moore, Cliven Bundy, and Zombie Reagan.
