Quick question. With the lockout apparently coming, can the college underclassmen who have entered the draft return to play in college next year if there is no NFL season? I have heard that once they hire an agent they lose their NCAA eligibility. So as long as they don't hire an agent can they return?

It's my understanding that they had to declare for the draft by a date in January (a few days after the BCS game) and that decision was irrevocable. There were many pundits who said it was unfair that these kids were stuck making this decision not knowing about the CBA (or even if there's going to be a season). There was talk of delaying the date until March but it never went anywhere. It doesn't matter if they have hired an agent or not - if they declared then their eligibility is past.

Because of the lockout, the NFL extends their exclusive deal with EA for video games to 2013 rather then give back money for probable lower sales this year.

If EA wins the lawsuit against Keller it won't matter. By winning the lawsuit they will show that such agreements are superfluous and any software company will be able to make the game.

Thus it was a good idea to stick it out in school another year and finish one's education, like a certain awesome Heisman first runner-up QB.

Exactly!! Its not like the possiable lockout hasn't been out there. If I was a College Coach, I would have been making a point to show my stars texts from some of my past players that are in the show, that are talking about the lockout and what they might have heard about it.

How so? The Keller suit is about what constitutes a likeness. All an EA win does is get us back to the 1980's where you have games called "Pro Football Challenge" with teams like the Colorado Donkeys featuring Sam Sebow. It does not negate the need for contracts with the league and/or player's unions to use actual names, portraits, logos, and mascots.

All an EA win does is get us back to the 1980's where you have games called "Pro Football Challenge" with teams like the Colorado Donkeys featuring Sam Sebow. It does not negate the need for contracts with the league and/or player's unions to use actual names, portraits, logos, and mascots.

I haven't followed it too closely, but one of the amicus briefs argues that even the agreement between the NFLPA and EA is not needed because they can use the likenesses and names without permission. They do it because they want the athletes to help make and market the games. From the team side, logos etc still have to be licensed, but the argument is that if I wanted, I could make a game with Tim Tebow as the QB of the Denver Ponies, a hockey player named Sidney Crosby of the Pittsburgh Seals and Albert Pujols of the St. Louis Red Birds. I can also make a movie starring a digital representation of Angelina Jolie and have "her" promote my product and not have to pay her a dime. A lot of people have signed on to this lawsuit because they think eventually it will end up before the SCOTUS and they want the precedent.

Yeah, good luck with that. I know there's caselaw out of California that explicitly says a person owns the trademark of their own identity, and there are definitely state torts out there for misappropriation of identity/likeness for commercial purposes.

Might not be any on the Federal level, but if that's really the argument they're going for, I see them losing bigtime.

There's a huge difference between "generic white QB with same number and stats as Keller" and Keller himself.

Not so much EA, as all the people who have sided with them.

I am not a lawyer and have no idea how this will turn out, just repeating things I've read.
