If the Supreme Court gave a legal basis for DACA to continue that would survive Trump’s power of Executive Orders to overturn it, then it would be an actual lasting victory. But Trump can just overturn DACA tomorrow by fiat and the Supreme Court gave the legal basis to do so.

Any executive action can be overturned by a later executive, you just have to follow the APA. That's not surprising and shouldn't come as a shock to anyone. The surprising thing is how incompetent Trump's administration is in simply following the instructions.

And if Trump kills it (not that he really has time to do so this term, since a rocket docket at the Federal level takes a minimum of 6 months), the next Dem administration could simply put it back in.
 
I can see it now - the fix is in. Conspire with the SC to rule against him, cry the SC he hand-picked is still politically charged against him and cry the 2nd is at risk (it isn't) if you don't vote him back in!

What I'm hearing Hovey saying is Court makeup doesn't matter so he won't care when we pack it with 4 new liberals.

You're actually closer to being right than you may have expected, or intended.

I tend to think that the court's members find their own place within the Court, and can even shift positions dramatically. I truly believe that if you put 9 carbon copies of Alito on the court, or 9 carbon copies of RBG on the court, those nine members wouldn't think in lock step. You'd see some of them shift.

So, if say Thomas or Alito or Kavanaugh or others end up leaving the court during a Democratic administration, or even if it's all of them, you won't see me coming here raising worries or clutching pearls. I really won't. There is enough legal precedent out there that I don't see the Court making broad swings one way or the other, regardless of its make up.

I’m fairly certain a website like FiveThirtyEight found that the lack of term limits for SC justices moderated them and some of their more extreme viewpoints, but that it mostly brought conservative justices towards the middle, rather than liberal ones. I don’t remember when the article was written, or if it was even written by FiveThirtyEight. I just remember reading it and finding it interesting.

That was the same article that found the current Court was the most conservative in US history, and that was back around 2008. It was the one with the pretty color-coded line graphs showing the tenure of each justice and their divergence from the mean based on decisions.

IIRC all justices drifted left during their tenure, until Thomas, after which the righties stayed hard, hard right. They finally figured out how to keep their puppets in line.

If you boys hadn’t tried to lynch him for having the temerity to claim to be a black conservative, Thomas probably would have shifted left too.

I also think the right wing lawsuits are getting more extreme and sloppy as someone previously mentioned. I don't like Roberts but when Chump's legal team is submitting documents written in crayon or claiming their case is about one thing when it's really about something else he seems to get p issed and vote against them and not because he's suddenly turned liberal.
