no, it IS different now. then it was 'sex' as in men and women. today that is 'gender'. 'sex' now is as in who one wishes to have sex with. so using 'sex discrimination' isn't what the laws were meant to defend. we now as a nation need new laws to protect 'sex choice' from being discriminated as a group. or just new 'anti discrimination' laws en masse

No, it's not different now. Gender is not black and white. Never has been. Science finally figured that out, now the law needs to apply as it was originally written.

This is entirely incorrect. The intent of the original law was to prohibit discrimination on the basis of biological sex. However, our comprehension of sex is now much more advanced and we understand its scope to include many other things: partner preference, self-identification, etc. However, that is all still sex. Therefore the original statute is sufficient to compel protection of all those rights.

You don't have to keep adding rights specifically for a protected class once its established. They are protected as they become part of the definition of membership in that class. We didn't have to add new amendments to cover the right of free speech on telephones or the internet -- they are covered under the definition of "speech" even though the Founders could not have imagined the new media. Such is it with the redefinition of "sex."

Societies get to declare their own rules through common usage. That is a political process but the few stragglers who didn't get the memo don't get to declare they are forever the default. That's not how living civilizations work.

It's true that when the statute was adopted 50 years ago people didn't think of sexual preference as part of the definition of sex.

But we do now, so that ends it.

You are saying something like this: "all the laws we passed about people prior to the 13th Amendment didn't assume blacks were included. So even though the 13th Amendment includes blacks as people all those old laws still only apply to whites."

Nope. Laws* change their meaning retroactively all the time. This is reason #681 why "original intent" isn't a legal theory, it's a fig leaf for right wing social engineering. There is nothing neutral about tying the precise scope of a statute to its original meaning for the people of its time: it specifically arrests social growth at that time for the political benefit of people who want to see change frozen.

The world changes. Often it improves. The people of today are not held as prisoners of the prejudices and stupidities of people of the past -- we've got our own new ones to enjoy!

So, Majority Rules then? Cause that legislation will never pass Congress. Hell, Abortion was decided by the Supreme Court in 1973 and in many places in this country a woman still does not have the right to choose.

Try again.

The Equality Act passed the House, but Trump isn't a fan of it, so McConnell won't let the Senate vote on it.

Because it's not yet been ruled upon as to whether or not it's a protected status at the federal level. So cities, counties and states have taken it upon themselves to preserve personal rights and dignity on their own.

We need a clean sweep for a lot of reasons. Since the GOP became a full fledged fascist party we need to remove their majorities from all three branches however that is legally possible. That means winning the White House and both chambers and packing the courts (it's not illegal). There are no norms anymore so we have to stop fighting Nazis who cheat by observing the rules of etiquette. To what end? We can rebuild civility after we've scoured these traitors out of our institutions once and for all.

This has been coming for a long time -- at least 40 years but really it's been the worm in the apple right from the beginning when the feudal slave states were allowed to join the union as a necessary evil to present common cause to fight off the British. We have been two countries for 200 years -- a smart, tolerant, liberal one and a dumb, vicious, conservative one. It's taken a long, long time but we are finally reaching the tipping point where the truly stupid are lurching into the minority. For the first time in history the smart people don't have to hide and pretend the dummies matter.

But before we get to the end we're going to have to deal with all their pent up hatred and bile and idiocy. That's what this is. It's been a long time coming but we're this close to being free.

Yeah I had to google it because I had never heard of it for a criminal trial. I was shocked to read Oregon still had it.

And today, I also read that the trans case was mostly arguing about trans people in bathrooms, not about hearing any actual legal arguments. So excuse me while I feel ill.

And Hovey...yes, 26 states say it's okay to fire me for being bi/pan and trans. My problem is that the 26 states includes Michigan, and our brain dead Republican state legislature will never authorize LGBT civil rights because of "religious freedom." Understand now?

Bear in mind, I am willing to share what I know and point you to resources that can assist you in acquiring knowledge up to a point. My mom was disabled from birth and grumpy about it her entire life, so I have a fair amount of patience. However, if I can tell you're choosing not to understand, I will sigh and move on.

Because there are lots of *******s like you who would still infringe on their civil rights even though it really is that clear. Just because everyone agrees that murder is clearly wrong does not mean that we don’t need laws against murder. Quite the contrary, and only a murderer would argue otherwise.
