If he's passing a police line, then he's asking for it.
If this was a murder scene and they had tape up, he'd be told to stay behind the line and if he didn't he'd be arrested.
My impression is that the Ferguson PD would much rather the media just leave them alone so they can keep up the racist police work.

I've seen a few people on MSNBC this past week being interviewed claiming to be media members. I'm sure their blog that gets tens of hits every year is important to them, but that hardly makes them worthy of credentials and claiming to be immune from prosecution if they are breaking the law.
If a cop tells you to move back, you move back. You don't sit and argue it with them because two things are going to happen:
1. You're likely to get arrested
2. The courts will back the cops. Always have and always will.
There was a local and respected lawyer on a local sports radio station (of all places) that said as much. "It's just the way it works."

Based upon what? First the narrative was this was a sweet kid just about to enter college while doing nothing wrong that day, and now we seem to have incorrect eyewitness testimony about the kid being shot while running away. This immediately brings in additional doubt that the cop fired while the kid was doing nothing but putting his hands into the air while complying with the cop's demands and demonstrating zero discernible threat or signs of aggression. It sucks like hell the kid died, but it reads more and more he forced the result upon himself.
