:D That is a serious stretch and not even remotely correct. My memory may not be correct, but the 6th amendment deals with right to speedy trial or something like that, and the 8th regards excessive bail, fines and cruel or unusual punishment.

And that's exactly why it is correct. Did the person get a trial for the crime? Is killing the person instantly not grounds for "cruel and unusual punishment"?

You are obtuse, I will give you that. You know very well that this is not a black and white situation. Please reference a court precedent that shows where a court has rendered a verdict of a violation of the 6th or 8th amendment in a case of law enforcement killing or shooting someone.

I think those rights go out the window when you're taking away the right to life, liberty and the pursuit of hapiness of another individual. I have no problem with people defending their rights, but as soon as something you do takes rights away from another person, that is when I start to have a problem with it.

Adjusting a bat now calls for a dismissal of Constitutional rights? And actually, what you describe is protected under the Constitution. It's the 9th amendment.

I'm not referring to a specific incident, I'm referring to the general situation of threatening a police officer with harm, whether it be with a gun or another weapon. And I'm aware that it is part of the constitution.

At 3AM, adjusting a bat can look like a whole slew of other things, depending upon the view the officer had to that kid. What happened was stupid (for the kid being out at that hour and the officer being too jumpy) and unfortunate, but in no way could that ever be considered a crime. If the officer identified himself to the kid, the officer would have reason to think that such a motion as adjusting a bat could be something dangerous, like the start of the act for bringing around a long-barrelled shotgun or rifle. The officer has to protect him- or herself.

This story takes the cake.

Technically, the coach is suing because when the kid tossed his helmet it hit the coach in the lower leg and caused his Achilles tendon to tear. That makes me wonder as to what the hell the coach was doing that something like a celebratorily tossed helmet could cause such an injury.

14 years old and playing little league?

The kid should file a counterclaim alleging that his coach was negligent in his failure to properly teach him what was and what was not "part of the game" and claim the experience has left him with fear of coaches, helmets, and America's favorite pastime. Has to be worth millions.

Junior League ages 13-14 and Senior League ages 15-16 all fall under the umbrella of Little League also.

Little leaguers are supposed to be buying bubble gum and baseball cards at the corner store, not condoms.
