Guy was already there when her shift started. Seems to me making sure your patrons get home alright all the time is a lot better business practice than having them go out and bust themselves up.

He was drunk when she arrived. She continued to serve him. When he left, she called the cops instead of stopping him and calling a taxi for him. If I had a bar, I wouldn't want her tending it. Her boss should have fired her, but for different reasons.

I believe that's most people's problem with this story. She was fired because she's "bad for business", not because she failed to make the right decisions from the get go. There is more to this story, I think. He was a regular, and she had allegedly worked there for awhile. Since she didn't cut him off, and apparently didn't try to get him a ride first, I think there may be some sort of personal grudge here.

I don't think that she did overserve him. But she didn't cut him off either.

“I came into work, he was already there, pretty much hammered,” DeVito said.

DeVito said that the man was a regular at the bar and also served as an officer at the Legion Post.

“He ordered a beer, I gave it to him, and then I started to try to slow it down, serving him,” DeVito said.

You're right. There's more here than meets the eye. Every state has dram shop laws holding liquor license holders to a potentially disastrous standard when it comes to drunks. And even though drunk driving is a terrible problem (we've all driven by "neighborhood" bars at 9:00 in the morning and seen cars in the parking lot) she had options, especially for a "regular." By her own admission, she didn't cut off a customer who was already hammered, which is her legal responsibility. "I tried to slow him down" is purely self serving b*ll sh*t. Maybe he said or did something to p*ss her off and she called the law as payback. If it were my place of business, I'd fire her back to bartender's school. She's no hero. More likely a spiteful b*tch.

"I stand by what I did and I would do it again." That's swell, sweetie, tell your story walkin'.

If he really was "pretty much hammered", then she should've refused service. In the interest of making my sh*t not stink, I vaguely recall my senior bar crawl, and being refused entry into the last two bars on the route, because I was obviously blitzed. It was the right call by the ID checkers at each door.

Serving an intoxicated patron is overserving them. According to her description of events and the outcome of his breathalyzer test, she overserved him. And there might be a provision in the law - might being the operative word here - that a server is required to attempt to stop a drunk patron, and, possibly, to try to find alternate transportation home for them. Besides a cruiser, that is.

Last May some Harvard MBA types who were about to graduate came to Portland to blow off steam for a weekend. Staying in the Old Port, they wandered around to some of the local watering holes. They weren't driving, but one of them got shut off anyway, and was asked to leave. Outside, the bouncer tried to get the guy to take a cab back to his hotel. He refused. And was found in the bay a few days later. Because they shut him off and tried to get him a taxi, the bar seems to be avoiding criminal trouble. They will undoubtedly be served with a civil suit by the widow and child, however.

More than 30 times the totals racked up by the Republican contenders, one of whom is a convicted felon. Kelly was helped by over 2 million bucks from Nanny Bloomberg's PAC.
