Nice Planet 2011

Re: Nice Planet 2011

Apparently Opie and Anthony just tweeted that George Zimmerman has been arrested. I'd believe them, but I'm buried underneath this giant grain of salt.

Re: Nice Planet 2011

Florida prosecutor is going to charge George Zimmerman. Exact type of charges not revealed yet. Presser in a couple hours.

I'm gonna guess some form of manslaughter. They may or may not be able to make second degree murder stick, and I suspect they're afraid to overcharge and have him walk like Casey Anthony (especially considering Sanford probably goes up in flames if that happens.) Probably why they turned down a grand jury as well. All depends what they've got.

Well, forget what I just said. Murder 2. Wonder what they've got - it's probably pretty ****ing if they turned down a grand jury.

That'll placate the masses, but if they've got nothing and he Casey Anthonys his way out of this there's going to be hell to pay.

He'll walk, like he should, guaranteed. They're just doing this to shut up all of the dumbasses that are protesting.

Re: Nice Planet 2011

If that's the angle than those same dumbasses will splode after he's released.

Yeah, unless they've got something ironclad the prosecution's pretty much ****ed if they do and ****ed if they don't here.

Decline charges, tell him he better GTFO for his own good? That's a riotin'.
Play it safe with lesser charges that they know they can make stick? That's a riotin'.
Get him to plea bargain to something like manslaughter? That's a riotin.
Push for murder charges, come up with nothing and he walks = oh, you best believe THAT'S a riotin'.

Not to mention he doesn't have a prayer in hell of getting an untainted jury. They're going to have to go to freaking Timbuktu to get 12 folks in the box.

This is a disaster no matter which side you believe.

Exactly correct. Far too many of us went to the mattresses on this one knowing only the barest minimum about this case. Sadly, this case has become a racial template, used by people with no conscience to enhance their status. Assuming the prosecutor didn't cave in to the mob (she's a tough law and order type) in court is exactly where this thing belongs. And in court, all of the so-called witnesses (the ones who actually testify) will be subjected to cross examination (Zimmerman's lawyer is likely to be a tad more skeptical than the Al Sharpton Network has proven to be). And Zimmerman will have the presumption of innocence. Unless there is some bombshell evidence we haven't heard about, my sense is it'll be tough to convict him (especially of the top count). After all, his is the only side of the story available. All bets are off if there's a witness who actually saw the shooting, and has a version at variance with Zimmerman's.

Can you imagine jury selection in this one? Disqualifying potential black jurors by the defense, white jurors by the prosecution? Change of venue? To the panhandle? In Florida? Trials are televised in Florida, I would hope this one would be so we can all see the proceedings. And ameliorate the inevitable mythology, no matter how it turns out.

According to this profile, the special prosecutor has a history of avoiding grand juries, so take that for what it's worth.

Re: Nice Planet 2011

Just be glad none of us will be a member of that jury. Especially if the prosecution can't prove Murder 2, and they have to let him walk.

Not to mention the length of the thing and possible sequestration. Think of people spending weeks in cheesy motels, treated in some cases worse than jail inmates, mail read, phone calls and TV viewing and newspaper reading monitored.

And with the memory of the Casey Anthony jurors receiving death threats and having to flee the state fresh in their mind.

I wonder how many people flat-out refuse to sit on this jury. I'm sure there are people at this point who would gladly take a contempt of court charge over a riled up public calling for their head.

I think that the protests against Zimmerman specifically are absurd. Protesting that idiotic, dangerous law, please, be my guest. But we don't have the facts. So to assume that Zimmerman is guilty is exactly as ignorant and moronic as to assume that he is not guilty.

On another note, I'm curious as to what people think about the Ozzie Guillen bruhaha. For those who are unfamiliar, the gist is that the manager of the Miami Marlins baseball team, who has a history of putting his foot in his mouth, and whose English is fairly bad despite having lived here for something like 30 years and being a naturalized citizen, was quoted in a magazine (Time?) as saying that he loves and admires Fidel Castro. The team suspended him without pay for 5 games. He issued an apology to Cuban immigrants which I believe may actually have been sincere. (He is not Cuban himself, but Venezuelan, although a US citizen now)

Barring some shocking piece of evidence we don't know about (security tape of the actual shooting that shows Zimmerman standing over the kid and blasting him) I'd put the chances of him walking at about 80% or better based on what we know now, plus the presumption of innocence.

I have only recently outgrown my hatred of the White Sox. Anyone in Chicago who says "I like both the Cubs and the Sox" is either lying or has been to two games his entire life. I've been to Comisky about 4 times and on each occasion it wasn't my idea and somebody else paid. I'd guess I've been to Wrigley maybe 150 times, maybe more. All four years in high school I had a season long pass.

Ozzie made his comments in Miami, where they're trying to sell tickets to Cubans among others. It's the 3rd rail. Even so, Castro is yesterday's news. We're all just waiting to print -30- at the end of his story. That doesn't make him not a savage Commie beast, it just means his biggest days are behind him. So I'd give Ozzie the benefit of the doubt on what he said. If he were manager of the Mariners hardly anyone would have noticed, let alone cared. The suspension is probably about right and he should easily move past this episode. I don't think he meant to imply solidarity with that thug. A little charm offensive here with the Cuban community wouldn't hurt.

This is probably analogous to someone calling Hitler a genius. That's not an endorsement of Buchenwald, although some would react as if it were.

Except for the fact that the "idiotic and dangerous law" probably isn't going to matter either way...

Aren't we always allowed to defend ourselves? If, as Zimmerman says, the kid was knocking the snot out of him, wasn't he permitted to use lethal force to end the assault? I guess that's what the jury will decide.

Right. His lawyer could obviously choose to take a different path, but it seems to me it will be a more "traditional" self- defense argument, rather than anything to do with stand your ground.
