Cops: No Snarky Nor Positive Title

Here is a question for uno, since I think he has said that either he or his wife have been involved in some defense work at some point.

The cops in the George Floyd case have asked for a dismissal due the leak of information regarding Derek Chauvin's supposed willingness to plead guilty last summer.

Obviously, for any prospective juror, that has to be something that sticks in the back of their minds. Is this a motion that has any chance at all of getting granted?

Leak of info to who? The general public? Not a chance.
To jurors in the middle of trial? Possibly grounds for a mistrial depending on how prejudicial the judge thinks the disclosure was, but again not a chance for dismissal.

I think the accusation is that it was leaked directly to the media.

I was just curious. I know there is a general rule that settlement discussions in civil cases, and plea discussions in criminal cases, are not admissible into evidence. That sort of seems obvious to me. However, I am curious how judges will handle it when they are "introduced" in a different way, such as leaks to the press.
 
I mean, wouldn't you just leak it yourself as a defense lawyer if you had a case you were in trouble about if that was grounds to have things thrown out?

Yeah, I suppose, although in this case it was identified as coming from the prosecution side (by the media). I don't know that there are hard fast rules calling for dismissal of the case. I'm must curious what they'll do about it.

What if it was leaked that the prosecution agreed to accept a plea of 1st degree assault? That would sort of complicate their ability to get a first degree murder conviction, don't you think?

You know the sun is crap...it is no less disingenuous than when joecct would bring up hit pieces from the Washington Examiner. (or Politico using the NY Post to attack Joe Biden over Hunter)

So, somebody here recently posted this thing about people on the extremes lacking the ability to perform complex thought processes to solve a problem...

In fairness, joe would go one step further than even the Examiner and link to the Moonbat Times (aka Washington Times).

So just four days after their loved ones had died, four days after they had narrowly escaped death themselves, Liverpool supporters were confronted with those headlines. People actually believed those headlines. Those who were there did not believe the headlines of course, nor did those who knew people who had been there.
