Someone on TikTok or Bluesky posted the audio of Roberts laying into the US lawyer during the Tariff arguments today, and there was a couple moments where Robert's had quite the pregnant pause in his monologue where it felt like he realized the Pandora's Box he opened by giving the President unchecked immunity and how no matter how he argued this point about tariffs, he could never re-contain Trump.

Exactly. Do they really think Trump will knock off the tariffs just because they declare them to be illegal? They'll be illegal but un-prosecutable, which is the exact same result as legal.

I cannot wait to see Roberts face when this happens. The man so interested in history and institutions and integrity.

The issue I hope pushes Roberts to the light side is to protect his Major Questions Doctrine racket that he used to kneecap Biden. If he admits tariffs fall out of it then that ice cream castle starts to melt. That's why he asked "who pays for tariffs?"

I was listening to the session and my god White House Counsel has all the presence and demeanor of a 9th grader at Debate Club. That's what they are left with: Roman Polanski doing an impression of Lucille Ball?
 
Gorsuch does not appear to be on Trump's side...only Alito and maybe Thomas are.

If Roberts had the stones of a flea he would gather them in chambers and lecture them that this will be 9-0 to restore checks and balances or they'll never write another majority decision.

There are a few vital Unanimous Rulings and this is one of them.

IANAL, thank god, but would it not give cover to somebody who refused to apply the tariffs? DOJ would sue them; the suit would be overturned, the tariff declaration would be impotent.

Unsure if related or unrelated, there were some articles I read last weekend that hinted that the SC wanted to lean more into "originalist" intention and less "living document" rulings.

I mean, there are like two or three other pathways they have to reimpose them. They’re just not by diktat.

Like say using Congress as more than a cheer squad. What a concept.

The last 50 years have shown me that a Parliamentary government with a PM is better. Madison was a genius but he got that part wrong.

Plus, their small parties can actually have clout. Our setup actively squashes them.
