When Hillary gave it to her maid it was no big deal though.

Think with all the nominees people need to be fair as far as the good and bad. It's sad to see people only focus on one side of it.

If Hillary pleaded guilty or was found guilty of the same thing, it would be a big deal.

But that hasn't happened- nor has it even come close to happening. The two issues are not equal at all.

If allegations = guilt, then Trump should be not allowed to even take the oath.

Yet, 10 hours in front of the Congress yielded nothing. She was interrogated by the FBI nothing. More money has been spent investigating here than anyone in US History. I really don't understand your or Trump's view of the law. I don't get it. Maybe you can explain it to me?

I guess Petreaus should have fought harder and had better political connections. Maybe his wife should have met with Eric Holder?

Or maybe, despite your belief, the fact is Hillary just possibly, maybe, isn't a criminal and Petraeus is.

What was the difference in their actions? Are you going to make the case she did it unwittingly and he didn't? It's hard for me to believe that given her time in government and the emphasis placed on proper procedures of handling classified info.

Yes, your gut belief is correct even though the entire weight of the FBI, Republicans in Congress, and the department of justice spent countless hours looking into it and came up with zilch.

You need to stop expecting rational responses based on actual facts and reasoning.

Both sides are hypocritical, but if libs put up much opposition to Petreaus it would really be rich after the election we just had.

You do not understand classified information at all then. There are differing levels. Black and White never works. You need to see grey or just stop talking. Still waiting for your explanation by the way. You've epic failed so far.

I'm ashamed to bring this up. But, at the moment, the interment camps are still the valid law. Korematsu is still the last decision on that.

Even though we've gone though a lot of shame over it, apologized, and even Scalia has weighed negatively in on it- Korematsu is still the last decision on it, and is still valid.

However, there was a little know Bush EO that is likely to go into place, again- where people of specific countries (10) had to be registered to be here in the country. It just so happens that 9/10 were Muslim. Again, however bad that sounds, it held up in court, and was only turned off in 2011 by Obama.

(on a side note- the recent cries that Obama was being unconstitutional with his EOs on immigration- the courts have given the executive branch rather wide leeway in their ability to use EO's to do that. Certainly, it's "unconstitutional" this time is that they don't like the policy)

Unofan is the person best suited to comment on this, but I think we need to be careful how we characterize Korematsu. While it is true that it is still good law, it was the application of a well-established test to a specific set of facts. The test itself is not going to be overruled; the suspect class/strict scrutiny/compelling state interest test is here to stay. While a modern court would probably reach a different result faced with a similar set of facts, it would not have to overrule Korematsu. It could simply conclude that the same balancing test calls for a different result under facts distinguishable from Korematsu.

If we are ever faced with a similarly serious domestic military threat (perceived) from a country that is predominantly muslim, you can bet Trump will ride the Korematsu horse as far as it will take him. And most of those who put him in office will be behind him 100%.

Agreed, but with a few caveats.

Korematsu's conviction (but not the constituionality of the Executive Order) was overturned, basically on procedural grounds. This was at the district court level and was not appealed, so there's little precedence value.

Also, the Korematsu decision is difficult, some would say impossible, to logically square with the SCOTUS decision in ex parte Endo.

Terrifies me that this is open for discussion at all.

Completely agree that it's not all black and white, but fundamentally they both did the same thing wrong. His political connections weren't in the same league as hers though so he got charged and she didn't.

The FBI, led by a Republican, said it was a minor issue not worthy of prosecution with Hillary. Not "Libs". If memory serves, it was slightly more than that with Petreaus. But don't let facts get in the way.

He said it was 'extremely careless,' which I would argue was exactly what Petreaus did.

As I've wrote three or four times, they both mishandled classified information or were as the FBI director put it 'extremely careless.' One was as politically connected as a person could be and didn't get charged, the other person wasn't politically connected and did get charged. If you have a different version of events let's hear it.
