I'd actually say that's the camel's nose and for now we should take it. It's better than their usual act which is to pretend that any knowledge of racism and homophobia should disappear once you get inside the courtroom, Plessy-style.
Nope, that's still illegal. The language, as I understand it, states that a judge can take racism, homo/transphobia, misogyny, into account on sentencing, but it's not part of the initial charging of the crime(people like unofan can correct me if I am wrong).
It's better than what we currently have (nothing), but it's still too watered down.
