I'd like to see a court that merely interprets law against the Constitution. Silly ol' naive me I guess ...

That's not a naive comment, just an ignorant one. I'll wager you have not read 5 SCOTUS decisions front to back, just puking up what the right is feeding you.

I wonder if the Republicans are complicit. They postured into a corner and now they see they're gonna lose. They really don't want to give Hillary the chance to nominate an 18-year old Trotskyite. :p

Or maybe Obama told Reid force the vote and then I'll withdraw him.

I thought about how this plays out, and I just can't see the Republicans being able to approve him after the election during the lame duck session. They're only in session for about a week, so they'd have to skip hearings altogether under the guise that he's a known commodity. No way Ted Cruz doesn't filibuster that, and with the threat of being primaried I doubt Itch finds like 15 Goopers to side with the Dems to squelch it.

Stretch this out until next year and Garland isn't getting any younger. I don't see him getting re-nominated by Hillary when he's pushing 65 years old. Liberal activists are going to want someone younger and more leftie. Give them what they want and you've cemented your legacy with them right off the bat.

If Garland isnt confirmed prior to November he never will be you can bank on it. Hillary, by the logic of the GOP, will have a mandate to decide the Court and she will use it.

Agree 100%. If she gets elected and that seat is empty by the GOP's own words she has a mandate to pick whomever she wants and if qualified they are obligated to confirm him or her.

No, I don't think she would nominate him, and I doubt even more that he would accept the nomination.

But it would be one of the most epic trolls in the history of American politics and so much fun to watch the GOP go absolutely bananas.

Which makes October real interesting. Itch has backed himself into a corner, but the man has no principles so if it still looks like Trump is going south he can schedule some hearings before the election, and then hold a vote afterwards. I still don't see how this would work logistically but that would make it slightly more likely he gets approved.

I realize the Sandernistas won't believe this, but there's plenty of self serving reasons for Hillary to go uber-liberal with this pick. Were the GOP a smarter party (hint: they're not) they would have held hearings this summer on Garland like every other party has done for a SCOTUS nominee and then waited to see how the election turned out. If Trump won they could have easily voted him down. If he lost they'd be set up to approve him instead of whatever Hillary plans on ramming up their....

Highly unlikely GOP holds the Senate if Hillary wins the WH. Senate will get rid of filibuster for SCOTUS if there's an attempt to block a court pick. They can change the rules with a mere majority vote.

In theory nothing but they gain nothing if they dont. People already hate the Senate for inaction but now they would be going against their own meme of how the people will decide. Midterms would be a disaster for them.

Well, they would gain the repeated notion that big government is not effective. Data shows that to be untrue, but they will do what they can to make it so.

What are the odds Trump will try to rig some votes in favor of Hillary (I have no idea the legitimacy of such an endeavor were one to try) to frame her for fraud? Given what we've seen from him so far is it that crazy of an idea?

Who cares? He's about to get his a ss kicked by 10M votes. How does he claim that's all fraudulent? SPECTRE at their zenith couldn't pull of something like that.

Yeah...it would have to be in a state that is A) close in margin and B) a swing state he is expected to win for it to hold any traction. Then it would have to be a high enough number to make an actual difference. (most likely over 10k votes) Then, he would need to prove there was a link between the campaign itself and however the votes were rigged...

That would (maybe) cause for a call of recount but without any evidence in multiple states the election would ultimately be validated and the rigged state either recounted minus the bad votes or just thrown out altogether. He can fight it all he wants to after that but he will be dead. It would be a lot of effort and money for a result that will ultimately not help him win one iota.

It will **** off the Drumpfers though and I am sure idiots like Pat Buchanan will be calling for revolution...

Just go with Florida. It's kind of a tradition. It'll be fighting over the 330th EV or so, but he'll have his claim of "rigged".
