SCOTUS 10: Pack the Court!

1) I'm sorry but the notion that Dems should have let Gorsuch sail in and preserve the filibuster to fight Kavanaugh doesn't make sense. Either McConnell gets rid of the filibuster to confirm Gorsuch or he gets rid of it to confirm Kavanaugh. The notion that he wouldn't have done so in an election year flies the face of the dude's 30 year career of putting party over country.

2) Having said that, unlike the tax theft bill its a certainty the Kavanaugh gets confirmed unless he turns out to be a racist or something along those lines. If he's another John Roberts, aka a corporate shill but with no holes in his resume, there's no point in losing Senate seats over him to make a meaningless and toothless point when every seat counts (the ACA repeal example that failed). With the tax bill you get to reverse it once Dems regain power as the last 2 Dem presidents have raised taxes back up on the rich. Therefore a united front was important in the face of an unpopular bill. There is no "long game" on the SCOTUS. From now until the end of time, party with the majority will confirm their justices. There's no hand to play here.

I'm not saying McConnell wouldn't still kill the filibuster now, I'm saying you get more political hay out of making him do it for an unfavorable nominee a month before the election than you did by making him do it 2 years ago on a guy who, but for the Garland shiatshow, would've gotten confirmed 65-35 without incident and fit which the electorate had already forgotten what happened.

This.

Also until somebody tells me which voters are not going to vote for Manchin, Heitkamp, and Donnely because they didn't vote to confirm another far right scumbag to the Supreme Court I'm going to assume you're just appealing to authority and have no actual facts to support your argument.

Just because it’s a logical fallacy doesn’t mean it’s incorrect. That’s a fallacy in and of itself.

Sure if you assume their voters would rather they vote to confirm Kavanaugh. I kinda have my doubts on that but I could be mistaken.

If I had to guess they’d confirm mainly because Donnelly and Manchin are pro-life themselves and would be voting their conscience.

Which is interesting because Collins and Murkowski are supposed to be pro-choice and they are voting for him. Which shows you exactly how the two parties work. Once votes conscience and the other votes tribe. Until Dems get some of that tribe action going they're always going to be run over with a truck on every issue.

What political hay is to be made here? There's only one GOP senator on the hot seat, and that's Heller. He'd be on the hot seat either way. In the meantime, in the Senate and unlike the House, in this election the Dems are playing defense and have to win most of those double digit Trump states. Itch nuking the filibuster would actually help the GOP in those states. What you're asking for would have worked if it was a bunch of Goopers in blue leaning states facing re-election.

Yeah, the calendar is not kind to the Dems right now. Sure would have been nice if they realized that when they got all butthurt after Bernie lost.

The Republicans still need independents to get them over the finish line. Killing the filibuster to confirm a nominee with a net favorability rating that is already negative will push them away more than killing the filibuster to confirm a guy who most people were ok with. Politics is perception. The filibuster being gone seems normal now, but it wasn't two years ago.

I don't think they do. Republicans need lefties to stay home to get them over the line. If lefties didn't care that McConnell wouldn't hold hearings on Obama's nominee, I fail to see why they'd get excited over killing the filibuster?

One wonders.

80% of the voters prolly don’t know what a filibuster is :). Certainly not unless they seen the jimmy Stewart movie :p

They do know what a gov shutdown is and D always take the blame for that nowadays
And anything stopping a vote with tricks will click some bells

Depends what gets shut down. Office workers will stay home (and then get paid). Contractors won't get paid. Parks and monuments may or may not stay open.

Most of the government stays open. It's only a symbolic big deal, but it riles up the bases. Which, in an election year, is playing with fire.

Sure. It's interesting that this electorate is so dumb that they would blame the Democrats for a shutdown this fall before the election even though the Republicans control all three branches of government. Which includes both Houses of Congress.

But, that's exactly what would happen.

I'd tap the breaks just a little on the "voters are holding the GOP blameless" schtick until after the elections. Chump and the treasonous cult's popularity hasn't exactly been skyrocketing lately and every GOP nominee or incumbent is all in on the guy for November. I'm curious how close the margin gets in the Ohio special election in a couple of weeks.

It should be a Tsunami. It could be a wave. It might be just a nice soft current.

Re: SCOTUS 10: Pack the Court!

All indications (outside of media looking to scare up some clicks) show unless a county was like Trump +25 the R is going to sweat until election day.

Democrats haven't been blamed for a single shutdown in recent memory.
