West Virginia 8th grader sticks up for his first and second amendment rights

If it had a gun shown on it, I don't have an issue with the school telling him to turn it inside out. Hell, even back when I was in eighth grade we weren't allowed to wear shirts with guns on them.

West Virginia 8th grader going to regret his decision just like he should be regretting that justin bieber haircut. (Fantastic photo op for the NRA btw I wonder if the dad got any kind of kickback for that or if he was dumb enough to do it for free)

White said schools can place restrictions on students to prevent disruptions, but can't take away their First Amendment right to free speech.
Yea they can.

But, your school probably had that in the policy. This one didn't. It would be interesting to see the shirt in question. Wearing an NRA shirt is not disruptive to the educational process. The teacher's overreaction is what disrupted the educational process.

Schools have every right to restrict the dress code. However, they can't make it up as they go along...

Click on my justin bieber haircut link, there's video of the kid and his dad showing off a gun, and wearing the shirt. It's nothing really inflammatory. But seeing the kid talk with his parent I can't imagine that things didn't escalate very quickly with him in the classroom and that's just not going to fly.

Re: Nice Planet 3: I Can't Believe I Share A Planet With THESE People!

My school had a clause, even back before eighth grade, that allowed them to make it up as they go. Basically an "anything we deem to be inappropriate or disruptive, we can make you remove or turn inside out" clause.

Schools are not a free speech zone. This has been upheld time after time in the Supreme Court.

This. We had a "long hair" policy for males at my K-8, and there was no specific measurement. Open-ended language lets schools make up the policy (so to speak) as they go along.

If they had a phrase like that, then the kid is definitely in the wrong here. Not all schools do. I don't remember anything like that at my high schools (Not saying we didn't, I just don't remember, probably because nothing I owned would be against any policy....except hats :p ), and from your stories, your K-8 sounds more strict than mine was. Dress code there was pretty straight forward since we had uniforms (even then, a kid wore a Chronic the Hemp Hog shirt under his uniform shirt one day and only got a uniform infraction...which was less than a slap on the wrist).

BTW....after watching the video Foxton posted, that shirt wouldn't be allowed at my high school....no sleeves.

Yeah, we had unis (Roman Catholic school), there were rules for what the females could wear under their skirts (leggings, socks, etc, down to the color) and for males it was mainly the long hair, and ear piercings (forbidden). Even things like sweaters were regulated (uniform policy).

Ditto, but that's a private/parochial school. What kids wore in the 50's to public school would be nice to this old fart, but it's not happening.

Just saying that it's still a school policy. Yes, every school is different, but I'm guessing there's some open-ended language somewhere in the policy. Do I agree with the teacher? No, not really, BUT if there's policy in place.....the student doesn't have my sympathy.

They seized the house? I didn't see any handover of the title during that clip. ;)

I'm curious to know what you would call the Allies' overtaking of Germany from 1945 to 1989. That scenario is no different. ;)

Re: Nice Planet 3: I Can't Believe I Share A Planet With THESE People!

People are surprised that in this day and age and climate that a kid (8th grader) wearing a shirt to school with a gun on it causes a problem?

He was looking for trouble and his dad's an idiot for allowing it. My kid has a couple of t-shirts that I've told him he definitely cannot wear to school.

I have no sympathy for this family and I'm usually on the side of students when schools overreact to every little thing these days.

I'm shocked that people think shirts with pictures of guns on them are offensive. It's just so silly. Guns 'n' Roses t-shirts would never be allowed these days and yet they were everywhere in classes when I was in school... and I recall nary a school shooting all that time.

People have lost their way when it comes to apply simple sense to situations these days.

I guess playing Sweet Child of Mine in music class gets you expelled now, eh?
