Because the thugs are shooting unarmed people, from ambush or moving vehicles? Because Chicago has among the most restrictive gun ordinances in the country? One thing's for certain, the thugs weren't using "assault" weapons, worrying about which evidently has you and Dianne and HIM B1 lying awake at night, drenched in flop sweat.

In your dreams. Only a libstain gun control advocate would suggest the efficacy of guns in self defense can be determined by incidents where unarmed people are gunned down by criminals--none of whom seem to be influenced by your beloved gun control measures.

Include ACLU director Anthony Romero on the "list of people I can do without" after his criticism of the government for invoking the public saftey clause and not reading thing 2 his Miranda rights.

I hate to say it, but thing 2 is an American citizen, committed a crime in the USA, did not commit treason, and thus should be afforded all the protections under the Constitution. I think James Holmes had his rights read to him, and he killed a lot more and his was up close and personal.

The Constitution is not a living document that can be interpreted one way for crime 1 and that way for crime 2. All criminals need to be treated the same once they are arrested.

Thing 2 is entitled to legal representation and should be subject to the Miranda rules. It stinks, but that's the price we pay for having this Republic.

I think the public safety exemption should/will be used to ascertain, in the short term, to determine if there are any others and whether there is still a threat. As soon as they are done with that phase, he will have his rights read to him and the prosecution will move forward.

As they're inserting the needle in his arm, we can apologize. Since they had other explosives prepared, the public safety exception is entirely appropriate here. We do not need a statement from Thing 2 to convict and execute him. The video tape of him setting the bomb down five feet away from Martin Richard should do nicely. Along with whatever forensics are on the recovered bomb parts and in his apartment. Having a video tape pretty much seals his fate. Holmes had no potential connections to foreign terrorists. If he had he, too, would have been a national security exception. Similarly, there was a theatre full of people who saw him commit his crimes. So establishing his guilt wouldn't have been too difficult.

I'm no legal expert and I don't know the modern legal definition of treason... but if it turns out these scums did have some even loose ties to a terrorist organization, I would think a bombing like that could be considered an act of war... thus treason no?

Regardless, I agree that the public safety exception would certainly apply here and thus there is no need to read him his rights.

That exemption only lasts so long. You need to read him his rights at some point.

I'll post the same thing I posted on GPL:

I have absolutely no issue with the government not reading him his rights immediately. They need to assess whether or not it was just the two of them, whether there are future threats we need to worry about, and then glean any information we can about the training operations (although I fear that information died with the older brother since he seems to be the one who pushed this). I believe this will be a short term play where they attempt to extract that information from him. Once this phase is complete, they will move onto the criminal prosecution and read him his rights. Again, I have absolutely no issue with this plan if it plays out like this. I would, however, like to see a lawyer observing the initial questioning (even if it's behind glass) to make sure it's not used in the criminal prosecution.

Regarding the actual reading of the rights, I'm wondering just who in today's age doesn't know about the right to speak to a lawyer. If they don't understand that, do they have the capacity to even be tried in the first place? I mean, anyone with a shred of intelligence will request a lawyer prior to talking to the police about any criminal investigation. This formality of reading the rights is a bit silly anyways. Have people seen someone read their rights? Are they always given in a situation where the mental state of the suspect would allow them to fully understand it? Are the officers reading it in a slow and measured manner? Now even going beyond that, how do we know that someone who didn't already understand these rights have the mental capacity to understand them in the field while being arrested? It's a bit silly when you really think about it.

I see it like when they are about to release dogs on suspects. More often than not, the officer will basically speak as rapidly and as unclear as possible before they release the dog. How is a suspect supposed to understand and comprehend it when most of us in a calm setting would struggle to understand what the officer had said?

A West Virginia eighth-grader student has been charged with causing a disruption at his middle school after he refused to remove an NRA T-shirt that he wore.

The teenager was reportedly arrested and suspended last week after getting into an argument with his teacher about a National Rifle Association T-shirt he wore to school.
