I'm sure it has something to do with the difference between "prurient interest" and "art."

Technically, it can still appeal to the prurient interest and be protected...it just can't solely appeal to the prurient interest without any artisic merit.

Though I don't know how that works with things like child pron as opposed to the regular stuff, though I think it's roughly the same.

A judge I worked for got skewered by Fox News a few years back after he ruled the prosecutors failed to prove that the "Podunk Theatre for the Arts" was really a strip club and not an actual performing arts theatre. Of course, Fox News blamed the "activist judge" for allowing 16-year olds to strip and not the prosecutor for screwing up his case.

Oh, and as far as movies go, I watched a decent amount over the weekend to clear out some of the things on my netflix queues (instant and disc) while the wife was gone for the weekend.

Zombieland was way better than it had any right to be. I normally hate Woody Harrelson movies, but that was probably the best horror/slasher movie I've seen in a decade. Bill Murray just added to it.

Blindness sucked. Interesting premise (random infectious agent causes people to go blind instantly - the blind are then quarantined into wards simlar to a refugee camp), but too many plotholes and characters randomly changing their characteristics. As depressing, society-turns-into-a-3rd-world ****hole movies go, District 9 was way better.

Also watched Mortal Kombat again for ***** and giggles. I forgot Highlander played Raiden. The soundtrack is still awesome to this day.

Finally, capped it off with some Total Recall from the personal DVD collection. Good times.

Funny, I had exactly the opposite reaction. It really disappointed me -- it failed as a zombie movie (which is a bad sign) and as a rom com (granted, its heart wasn't really in it). It was a passable comedy, I guess. Murray was genius, but man watching Woody's like having a toothache on a Friday night and knowing your dentist won't be in until Monday.

To be fair, "the double tap" has become a fixture saying in our house.

I am about the last person you'd think of when it comes to being "cultured" and even I see some good qualities in Shakespeare's stuff. :p

Just watched Kick A s s. Fantastic...

That movie is rather under-rated. I watched it simply out of curiosity (had no interest in it until I heard about the minor controversy of the adult language), and loved it. I actually consider it purchase-worthy.

Finally saw Scott Pilgrim a few weeks ago, and I enjoyed it a lot more than I thought I would. The vegan police cracked me up.

Gelato isn't vegan?

It's on HBO which means it will be played 160 times this month, right?

I really liked it, too, in part because Mary Elizabeth Winstead's Ramona is one of the (extremely rare) attractive girls in a post-1960 movie.

Mary Elizabeth Winstead is gorgeous, no doubt. Not hot, gorgeous. Which I personally am far more attracted to.
