I'm sure they covered their rears on this... I just find it interesting... Especially since I was on the opposite end of the taking pictures with out permission thing when the Dark Knight was filming in downtown Chicago in the Summer of 06 or 07. Ended up having to deal with a 45 minute ordeal involving Studio people and Chicago PD because I took photos from a public sidewalk down an alley where they were filming the scene where the Gotham Mayor had the assassination attempt done on him. You could clearly see the stage and all the props layed out. The filming wasn't active at that moment however and it was just crew around the set. But still had to get harassed by an overzealous studio dude. Thankfully the cop who the dude brought over seemed to have gotten tired of the studio guy being a dick and basically just made me delete the photos in front of him and then let me go on my way.
In hindsight I probably should/could have held my ground... But I didn't want to deal with that sort of thing and sure as hell didn't have a clue to my rights regarding public right of way and such, so I just did what the officer suggested...
As it relates here, I just figured that anyone that didn't want to be filmed would be able to just not sign the release and that would keep them from using the footage. I'm specifically referencing the scene in the new movie that involves Guliani. I know he's dumber than S*** but I figure there is no way in hell he's signing a release after being filmed in a hotel room.
