So apparently the U of M adopted a new definition of sexual assault a little more than a year ago. Basically, any sex is considered sexual assault unless there is "clear and unambiguous words or actions" that consent was granted. http://www.startribune.com/university-of-minnesota-to-adopt-affirmative-consent-rule/311650821/

That doesn't mean a student can be convicted of a state sexual assault crime if they don't meet this standard, but the U can obviously act.

The U of M is not letting anything go in this case and as more and more information has come out most fans seem to be siding with them. Not sure how anything in that regard is on a par with PSU.

They mentioned that on ESPN- some students on campus apparently are supporting the president and suspensions, too.

Based on what both sides are saying, Northern Illinois better pack their bags.

The players are demanding information, the administration can't/won't give it to them.

It's funny that they keep bringing up "due process"- nobody is going to jail. The worst that can happen is that students will be expelled. As far as I know, one can be expelled for things that are not against a law....

Sounds like the Holiday Bowl is giving them until 1 eastern Saturday to make a decision before inviting NIU.

I have a real problem with the guilty until proven otherwise bit. Honestly, I don't think I would want to send my kids to a place where that was the policy. Hopefully someone works out a better system than what we have now. It doesn't seem fair to either side and colleges are setting themselves up for a lot of litigation.

So you are discounting the over 60 days that the investigation took place between the time that the DA dropped charges and the students were suspended???

Read the article that shirtless posted- first, they are required to do an investigation; second, they let both sides present their information; third, the burden of proof is lower, since the penalties are also less.

The players are claiming that they didn't get due process- but they did. The reason they are upset is that the ruling went against them, as I see it.

This is more like a civil case instead of a criminal case, where the burden of guilt is far lower. Just as the penalties are far lower.

I might have gotten some bad information. I had read somewhere that the burden of proof was on the accused to prove they were innocent instead of the other way around. It makes me feel better that it might not be the case. Still though, unless you record the entire encounter how else do you prove you had consent?

I was leaning toward the players, but once the report got leaked and I flipped through that, it's pretty obvious that it's not the hill to die on for the players. Morons.

Seems like a good decision by players to end boycott.

I think so, too. Given what I've heard via the news, the players didn't seem to have all the information, and they would have ended up being the bigger losers in the situation.

I wasn't the author of that article. If you want to blame me for its inaccuracy though that is fine.

I'm not sure what to take from that article. It's still he said/she said so if both parties are the only witnesses I'm not sure how someone can be found guilty without more proof (alcohol being involved, eye witnesses to the event, etc). The article goes a little to far to say you have to prove your innocent.

Granted, this isn't a court of law, this is student conduct so it can have a different burden.
