2014 UNH Wildcats: Ending Strong and Starting Fresh

Re: 2014 UNH Wildcats: Ending Strong and Starting Fresh

So Coach Wood didn't get invited back. Coach Wood also posted the pro-McCloskey message briefly on his Facebook account (or at least so I've been told earlier in this thread).

Coincidence? Or is that how BS got that 35+1 added to his USCHO moniker?

Re: 2014 UNH Wildcats: Ending Strong and Starting Fresh

So, we all remember that old game Telephone, that we at least heard of, if not played, when we were younger.....it seems that you can see the principles of the game in action again today, as you read in Fosters.com. It seems that Coach McCloskey has been indicted on 3 charges of simple assault, with 1 charge of criminal threatening....as you read thru the article, remember that he used to work for the "Live Free or Die " State.
Back to the article, and our game, it seems that back during the altercation that began this charade, Coach simply grabbed her jersey and pointed directly thru her face ask.....now Coach McCloskey, "has been charged with 3 counts of simple assault for "placing his body on top her body"".....and then if the other charge is considered "criminal threatening", for grabbing the players face mask, every coach in every game in the world would be brought up on charges!!!!
Honestly, can we all say frivolous? To what end does all this have, now that it seemed the team that had turned the corner and was looking forward to moving on and having a season of hockey again!
Is it the fact that since UNH is a State school, and the charges are being brought by the State have meaning? If Coach McCloskey was to win his case against UNH, does the money come out of the same coffers that fund the judicial system of NH? I'm honestly asking here because it makes no sense to me why Pres. Huddleston, MS and UNH keep replaying this record....
As DC78-82 mentioned in a previous post, during the summer months, MS and his plebes have been trying to negate the Friends of Women's Hockey Board members that had the audacity to pull the cover off MS's version of events.....none btw, that were supported by any photo's, no video, no eye witness to said "altercation"....including the team Captain and 13 other team members!!
So is UNH on a vendetta to prove themselves? To what length will they go to save MS and his job?
Well all that would be speculation, and I'll leave it to this thread's posters, but one thing that has been verified having changed since May......it seems now that the player at the crux of the altercation is no longer "of walk-on status"....she now has her remaining 2 years fully paid for with a hockey scholarship!! Word has it that even if new Coach Witt cuts her, she will keep her scholarship......
Your right qiwan, there has to be much more to this story but it resides on the State's side.....a man was offered a three year extension to the same job he had been doing well for 20 years, just 2 months before an altercation became a new form of extortion, and now it's anybody's idea do what's going on!! Do you believe in UNH anymore?

There has to be much more to this story than is being printed.

I'm not sure that is true - this is all about winning the wrongful termination suit brought by Coach McCloskey and is pretty standard legal wrangling. Coach McCloskey sued UNH for wrongful termination. UNH initiated an investigation that resulted in criminal charegs being filed and potentially negating the wrongful termination suit. Coach McCloskey will defend himself in the legal process and likely use the fact that UNH initiated the criminal process through the "assaulted" player only after he brought suit, that the player apparently was given a scholarship after bring charges against Coach McCloskey (a form of compensation - I only read that on this forum and don't know that myself), and that UNH and the state are affiliated entities in his defense. If he wins his criminal case, he will have a fighting chance in winning his wrongful termination suit. If he loses the criminal case, UNH will likely win the wrongful termination suit. This is now in the realm of the judicial process - right and wrong are only a small part of the process now. But it's all out there....and it will go one for a while until fully resolved.

A prosecutor is only doing this to influence the outcome of small civil lawsuit brought by a women's hockey coach? Really? Was the grand jury in on it as well?

Re: 2014 UNH Wildcats: Ending Strong and Starting Fresh

Glad that you lawyers are debating the issue cause this layman hasn't a clue but one thing I mentioned before, is that the team was looking forward to getting back to hockey, and that's it....since we all know how slow the judicial system works, apparently UNH is willing to forfeit another year to this issue.....it might not be their fault but only if you believe that running out the clock has merit....own up to your mistakes, isn't that we teach, or coach, our kids to live by? Oh yea, not in the real world where money is king!!!

I note that when MSU terminated the football coach, the prosecutor brought the coach up on 2 felony counts and pursued them. The disctrict judge eventually dismissed the charges. At the press conference after the coach was reinstated to his job by an arbitrator, the coach's lawyer was outspoken and had lots of very harsh criticism for the actions of the prosecutor in the case.

Back to hockey...

Re: 2014 UNH Wildcats: Ending Strong and Starting Fresh

Nice to see the trip to Columbus and the Badgers coming out for the long weekend. Interesting starting with a conference game. It's a great schedule and an exciting new start for Coach Witt, Jones, and Bowes. Zoofer, is it time for a new 2014-15 thread? I think the coaches and players deserve a hockey only thread and any discussion on the "other stuff" could remain on here.

Interesting to see the Blades playing both UNH and BU this season -- usually they just do a single exhibition game against a college team.

No. The prosecutor is doing it because its their job and to grab publicity and get attention to further their career. I didn't see any mention of a grand jury but I could have missed it. Regardless, the burden of proof for a grand jury is almost ridiculously low - the prosecutor only has to show that there MIGHT have been a crime - the trial is where the real guilty/not gulty assessment occurs by a jury.

631:2-a Simple Assault. –
I. A person is guilty of simple assault if he:
(a) Purposely or knowingly causes bodily injury or unprivileged physical contact to another; or
(b) Recklessly causes bodily injury to another; or
(c) Negligently causes bodily injury to another by means of a deadly weapon.
II. Simple assault is a misdemeanor unless committed in a fight entered into by mutual consent, in which case it is a violation.

from a legal site in NH

Simple Assault

Simple Assault is a misdemeanor. Many people think that to be guilty of assault, they must hit or use force against another person. However, to be found guilty of simple assault, all that the State needs to prove is that there was some form of touching or contact, however minimal, and that the defendant did not have permission or consent to touch the other person.

I'm pretty sure we are all guilty of simple assault, somewhere, sometime. All it could take is poking the person in front of you in line to get their attention.

The key is whether this was "unprivileged". Body contact in the course of a hockey game is privileged because you expect it. Todd Bertuzzi pled guilty to assualt for his hit on the Avalanche player - it was outside the bounds of acceptable conduct, but that is an extreme case.

Coaching sports - body contact is going to happen, and some form of bodily contact is expected and privileged in sports. The problem is where is the line drawn. Unfortunately/fortunately, a state's attorney has "prosecutorial discretion" to bring a charge (an individual who files a complaint has zero control over whether a charge is brought). Every coach who demonstrates a drill or taps a kid on the shoulder could be charged by a zealous prosecutor. I have grabbed kids' jerseys to prevent them from going on the ice for a too meny men penalities.

So, was the coach's actions in this case so outlandish to rise to a ciminal charge? I doubt the coach will accept a plea. So, a judge could throw it out before a jury gets it, or a jury will decide.

Re: 2014 UNH Wildcats: Ending Strong and Starting Fresh

I agree with you 96Illinois dad, in that a judge will look at the relevant material and throw this out......remember that Durham Police, after being prodded to bring criminal charges, have thrown out this case, after finding no cause....mind you, they sent out Emails to everyone they thought had been at the game and might have seen the incident take place, to no avail.....
I totally agree puckskillz that a new thread might be in order....as I stated, all of us that have been behind the scenes for some 30 years were ready to turn the page and like the team, are anxious to move forward! Unfortunately during this summer, the Administration has refused to let us do this.....they have totally ignored the bylaws of the Friends group, to the point where according to said bylaws, there is NO existing group. Since we have had no meetings since April, and new officers weren't elected before the year ended, there is no Board.....so who is MS and the Administration dealing with? What booster club exists now? From what I've been told, according to MS, there's no need to do any fundraising this year, he'll take care of it......so given all this puckskillz, what do you think should be the new threads title? At what point is the page turned?

Rise Again CATS! 2014-15 season

Fresh start. Girls are working hard and all of the focus for them is forward. I am sure Coach Witt will have her own ideas on how to build the fan base and reach out to alumni. All of you that have supported the program over the years should be proud of your efforts and take pride in what was accomplished. You didn't have control over what happened on that November day and the subsequent events that forever changed the landscape. But at the end of the day it's about the hockey and the competition and with a new staff and renewed focus on the program, there will be a time to reengage. I hope all of you can regain your passion for the game and for the CATs. I personally can't wait to visit the Whitt again.
