Evidently the shop owner had seen the shooter challenging people in the parking lot previously. This was not a one off argument, but rather ongoing behavior...where the guy was using stand your ground to commit premeditated murder.

I think it might be time to consider replacing your current model. Based on recent posting, it's got to be close to "all used up". You certainly have gotten good mileage out of it though.

If that's true, then he clearly had no business carrying a concealed firearm, but the latter part of your statement is wrong. He should be slapped with a Murder 2 charge in this case though. Or at least, he would in a saner state.

This country is seriously effed up.

Where's Brent, yearning for the good ol' days where men settled their beefs with fists?

I do yearn for that, and also have said numerous times that isn't this world anymore, and it sucks. So stop trolling.

All violent racists should move to FL.

The store owner tells ABC Action News that Drejka has a history of assaulting people in the very parking lot the shooting took place. A man who frequents the store told ABC Action News he had a run-in with the man who opened fire just one month ago. Rich Kelly says the man picked a fight with him over a parking spot, using racial slurs, and at one point Drejka threatened to shoot Kelly.

"It's a repeat. It happened to me the first time. The second time it's happening, someone's life got taken," Kelly told the Tampa Bay Times. "He provoked that."

I don't care what you guys believe. SYG laws enabled premeditated murder.

SYG is good in principle, horrible in many rulings. This is not exclusive to SYG laws.

SYG is terrible in principle.

It rewards a full scale escalation to death of any confrontation. Any confrontation creates a threatening situation for both parties and by definition, you are both within your rights to kill the other. If you escalate to killing the other first (regardless of the nature of confrontation), you will be both alive and free. If you are the loser in the escalation, you're dead, the law will not defend you and there is no other lawsuit recourse. The only question is whether you or the other party will kill first.

If I am in true fear of my actual life, I expect to be found not guilty in defending myself. The cliched example is if someone points a gun at me. If I have a gun, they are getting shot at. Period.

If someone shoves me, I ain't gonna sweat it.

But don't stretch that to be SYG. Cuz its not.

As said, there are many behaviors that the law encourages that will result in deaths - both in terms of attempts to get away with murder as 'justified' and by the importance of escalating any confrontation to a shooting death.

In principle, you SHOULD have to fear for your life. Unfortunately (and in this world, go figure), someone calling someone a loser or bumping into you somehow qualifies, because we somehow can't quantify a person's fear. It's horrible.

In the cliched case, if someone points a gun at me, given my gun education, that means s/he's aiming to shoot at me. That qualifies as fear for my life.

I understand, but what you're suggesting in not SYG. Gun laws were on the books well before SYG...and many states without SYG still have strong gun death legislation. How many non SYG state laws (such as those in MN) have people arguing they represent a real travesty of justice?
