Was thinking the exact same thing. I don’t really see how they have any legs to stand on.

It would still apply if it was on the arena's property, right?

If it was on public property then oh f-ck they are in deep civil rights trouble.
 
It looked to me like she was in the queue along a road which I would think is city property.

Ah. Then how can she be "trespassing" at all.\? Doesn't even matter that it was political (although that's a serious civil rights violation on protection of Political Speech and Assembly from interference by the government) -- it's literally an impossible application of statute. I guess you could find her guilty of some BS charge like loitering but all the defense attorney has to do is show a photo of thousands of other people in line and, "dismissed."

if the city decided to harrass her to make an example that would be (a) stupid and (b) I hope very, very expensive.

Look, I hate Trump as much as the next person, but every ticket to every event I've ever been to has a disclaimer about the right of the event holder to remove patrons for any reason.

If the campaign asked her to leave, and she refused, at that point she is trespassing. And since the campaign isn't technically part of the government, the first amendment doesn't come into play either.

Now if the cops did it on their own without being asked, then that's different.

The campaign didnt have her removed from what I saw. The rumor was it was someone in line alerted the cops cause they didnt like her shirt. The argument was she was blocking traffic once she informed them she had a ticket. (she was sitting in a blocked off area so I am not sure that holds water) She apparently sat where the emergency vehicles would go if something happened.

And my posting it isnt that I think they werent within their rights. My posting it was the optics for the Tulsa PD who knew the whole time an MSNBC reporter and crew was showing it live. The cops are in the middle of one of the worst PR ****storms in modern times and they still cant bother to get out of their own way. It is just dumb. They didnt need to arrest her or handcuff her. She certainly wasnt going to fight off two of them. (later 3-4 when she was arrested) There was no haste to get her out of the way, no emergency vehicle was going to use the area any time soon. Wait it out and then pull her aside and escort her out. For chrissakes she wasnt even talking. Their actions made sure she was caught by multiple videos screaming and yelling and making them look like thugs cops on a power trip. (which I dont believe they are) Sometimes you just need to not make the situation worse. It went from a nothing protest by one probably 60 year old lady into something that will now be shown and shared for the next few news cycles.

Suppose it would depend on where she was in line. Assuming she was on the property of the arena, sure. If she was down the street, then no. But if the line started moving, the second she stepped onto the arena property, then yes.

Suppose it would also depend on whether the event had to get permits for the length of the line onto adjacent rights-of-way, then if she was in a permitted area without their permission, that'd still count.

Put another way, there's all sorts of fact-dependent outcomes. But generally speaking, the campaign has the right to exclude who they want for any (legal) reason or no reason at all. Whether that's agood idea or not is another matter.

Lucky she was white, or she'd have been beaten like a pinata.
