This photo that we've included in our report today is a lot more damaging than the photo of Nic out to dinner.

All three players are holding bio steel products and an agent is tweeting that out and including the products name in the tweet. Not good.

Apparently Kerdiles camp has said this has to be resolved by Thursday or he walks away from UW. I can't see this getting cleaned up that quickly either way. I doubt the NC$$ would just totally wash this out. Even if it gets reduced to half, why would he want to miss any icetime? The only reason would be Eaves is worth the wait.
 
No. Chuck has tweeted the picture in question. I think the issue the NCAA has with it is was being used to promote BioSteel by PulverSports.

I still think a year is too long.
I have a bigger problem with that shirt that guy is wearing.


Seriously though what a tough situation. I can see why the NCAA finds fault with that photo.

The majority of the blame is on the advisors in this case. Unfortunately, it's the kid who gets punished. We also don't know what else the NCAA could have looked into.

If the suspension holds up, the player should fire & then sue sports agency for four years tuition & housing.

While the pictures clearly show bad judgement, I fail to see how they show any impermissible benefits to Kerdiles. How is that any different from someone taking a picture of a bunch of athletes at a tailgate holding can of a beverage (for example, Diet Coke) and then tweeting it? Being photographed holding or using a product isn't an endorsement of that product, social media definitely blurs the line on that, but provided that Kerdiles didn't actually recieve any compensation for the photograph, a one year suspension is completely excessive.

I bet that if BioSteel was an NCAA corporate sponsor this wouldn't even be an issue.

Another reason why social media ( aka look at me I'm wonderful and important) is one of the crappiest ideas someone ever had.

I'd be really incensed by the Pulver Sports agents, as adults and sports agents they know what is and isn't acceptable and put a player's college career and possibly future in jeopardy. Real a-hole move by them.

John Infante, whose twitter title is, "Proprietor of the Bylaw Blog and NCAA Expert for Athnet" weighs in.

"Perhaps if Kerdiles had received compensation for promoting BioSteel, a one-year suspension might be in order. But so far, all that we know was that he was involved with a photo that, normally, would not carry a suspension."

He also added on twitter, "Dinner from an agent is maybe 3-4 games. Has to be something else. "

Come on NCAA, unless Nic received some sort of compensation for this, all he is guilty of is holding something in his hand while a picture was taken and smiling about it.

If the Duluth women's team can keep an NCAA title after having a player play half that season who played professionally in Europe for several games, Nic should get a slap on the wrist at best. W/ the NCAA the rules are never black and white nor administered the same way w/ regularity.

Advice to young players: talk to no one, only leave your house to play hockey and go to school, and even the second one is dangerous because you might be holding a pen and someone takes your picture and you are guilty of endorsing Bic.

Clearly they didn't know the NCAA rules and as a Toronto based agency its probably understandable. I'd guess that they don't have many other US college athletes as clients.

That being said, as "advisors" do have a responsibility to know the laws and rules of the United States, if they are conducting business down here, and that's why I would think that they could be held liable in a lawsuit. My 2 cents...

No matter what happens, this is very embarrassing to Pulver Sports.

My advice is an antique fountain pen from a now defunct company, or a quill and inkwell. Actually, I'm surprised that someone hasn't used one of those to sign his NLI.

No matter what happens, this is very embarrassing to Pulver Sports.
Ian Pulver is no greenhorn...he's a major lawyer for the NHLPA and should be well versed in NCAA rules, particularly with the growing NCAA traffic to the NHL.
Seems like the supplement photo, the dinner out photo and the online autograph give-aways might be what attracted NCAA attention, but I too, put the blame on Pulver for not acting in his client's best interest.
He's supposed to know how to advise an NCAA athlete. Instead, it looks like he was the crux of the problem.
The real shame is that Kerdiles is, by all accounts, very gifted academically.
The Major Junior teams all offer to pay your tuition.....while you're on the roster. Try getting to class between games....at a Canadian college.
