Wait he hacked her, stole images and it’s free speech ?
Is the judge an incel?

From what I read in the article, it's that pesky "obscenity" definition, which is "I'll know it when I see it." I do not agree with this court's decision, but if the "obscenity" definition is the cause, per the law, probably should take another look at that, or add language about consent/etc due to the digital age.

I think there’s some nuance here that isn’t apparent on face value. I find it hard to believe a unanimous decision among a three-judge panel could get this so wrong as it’s being described. If there are problems with the law, fix the law.

Just like we can’t lock up the worst sex offenders indefinitely after they’ve served their sentence, what’s always popular isn’t necessarily right. Easy to light the torches before reading the opinion and considering the implications.

Agreed. There has to be something in there that made the judges rule the way they ruled.

The fact he used her passwords is what really gets me. Seems like taking property.

Anyway here’s a paragraph I found:

“ Specifically, they said, the statute lacks a requirement that prosecutors prove an intent to cause harm. They said the language allows for convictions even if the defendant didn't know that the person depicted did not consent to the distribution of that image. And they said it allows convictions when the defendant didn't know that the person depicted had a reasonable expectation of privacy.”

A big question is, did she give him her passwords, or did he do some sneaking around and found the passwords? I know a lot of couples have shared accounts, and/or share each other's passwords. If she gave him access...well...per law he didn't steal them.

To me that is different (or could be). If they had a shared account, what is hers is his, and vice versa. Think like a joint bank account.
