I think there’s some nuance here that isn’t apparent on face value. I find it hard to believe a unanimous decision among a three-judge panel could get this so wrong as it’s being described. If there are problems with the law, fix the law.
Just like we can’t lock up the worst sex offenders indefinitely after they’ve served their sentence, what’s always popular isn’t necessarily right. Easy to light the torches before reading the opinion and considering the implications.
I mean, I get that. I nearly went to law school so I’m not a complete dummy on these rulings.
The fact he used her passwords is what really gets me. Seems like taking property.
Anyway here’s a paragraph I found:

A big question is, did she give him her passwords, or did he do some sneaking around and found the passwords? I know a lot of couples have shared accounts, and/or share each other's passwords. If she gave him access...well...per law he didn't steal them.
