No such vacancy ever occurred in 1992, and it's entirely likely that Biden would've been overridden in the political climate of the day.

So yes, it's a different situation, and not one that favors the Republicans, should they continue to play this game.

That's kind of a stretch though. He still advocated for it. He was wrong then and the Republicans are wrong now.

another part of that 24-year-old Biden speech, in which the future vice president said, "If the president consults and cooperates with the Senate or moderates his selections absent consultation, then his nominees may enjoy my support as did Justices Kennedy and Souter."

Yeah, that sounds just like what McConnell is saying.

How about we see how this plays out? So far the two are equal in their intent and not so equal in their rhetoric.

I'll grant you that as a jaded ex-conservative who learned better and turned moderate, I'm a bit biased; however blustering and negotiating are entirely different things. When Bork was famously "Borked", you can bet that the Democrats made some concessions in exchange for the Republicans agreeing to unanimously confirm Kennedy instead. Justice Kennedy has gone on, almost 30 years later, to be the deciding vote in Obergefell (oh no, t3h gayz!), but has otherwise been a moderate or even a decent conservative in many cases.

Seriously, I didn't even know Orrin Hatch was still in office. What is he, at least 80? *checks* Internet says 81.

Hatch has been around so long he started out far right for the GOP and now he's far left for the GOP, and he's never changed.

I was listening to Trent Lott this morning talking about how the GOP has gone so far right they're beyond lunacy. Trent. Lott. smh

I havent watched her show, but I probably should. John Oliver being on HBO is why the show is destined to be better than TDS. The things he can discuss and the depths of those discussions are incomparable.

Oh yeah, you need to watch. It's fantastic.

Nobody's "wrong" or right.

The Senate and the President are engaged in political gamesmanship over judicial appointments. OMG!!!!! Is that the first time ever? Oh, wait....

If there is anybody who truly believes that if the political roles were reversed we'd be seeing anything different from a Democrat controlled Senate, Donald Trump has some swampland in Florida he wants to sell you. He may have anyway.

The position of the Republican controlled Senate is for one reason only -- drive the base to the polls come November.

Honestly, that's the way our political system and the appointment of justices is set up -- it allows that, for better or for worse. All the gnashing of teeth in the world isn't going to change it, and it certainly isn't "wrong."

The President is going to throw a sacrificial lamb onto the political fire (that should be a great conversation, by the way, between the POTUS staff and the lamb). Obama knows there will be no consent granted by the Senate, but the theater will be for driving the Democrat base to the polls.

Personally, if I controlled the Senate I wouldn't do it this way. I'd play the odds, figuring the chance of both a Republican Senate and Republican President come January is less than 50/50, and cut a deal on a moderate with Obama. Obama would love to have another appointment as his legacy, and would gladly throw his own party under the bus to get it.

While this is all true, the rhetoric and discourse have been ramped up this time. I can find no evidence of a letter written by the entire faction of a party of a committee advocating for not even speaking to a candidate proposed by the President.

And this has been a pattern with the opposition ever since Obama got elected.

In every other facet of life you have to work with your opposition. I have to do it at my job every day. Apparently if you're a Republican Congressman/Senator that's no longer in the job description.
