Maybe now that the election is over the Courts won't be deterred as much by demagogery threatening to make them into the bad guys....

we had written about this issue earlier, a so-called "recess" appointment that was made when the Senate actually was NOT in recess.

A federal appeals court on Friday ruled that President Barack Obama violated the Constitution when he bypassed the Senate to fill vacancies on the National Labor Relations Board.

The three-judge panel said that as a result, the labor-relations board has lacked the quorum it needs to conduct much of its business

this is general news, I found the story here but you can find it in half a dozen other places just as easily.

Actually, they come from both. If your side is the same as the dissenter's side, you're likely to be part of these "attacks". ;)

I truly have no idea what you are trying to say here...are you being clever, or cryptic, or deliberately obscure? These days, doesn't it seem like the Court is under attack from anyone who dislikes one of its rulings?

I merely quote them, if you don't like reading what they actually said, why criticize me when they said it?


because I am critical of certain parties does not at all make me affiliated with other people who also criticize those parties! If you pay attention I'm critical of career politicians period. When one party was in ascendancy I criticized them more because they had more influence; with a different party in ascendancy I now criticize it more, for exactly the same reason.

Trust me, I fully realize that hypocrisy is one thing both parties have in common; you might say there is a broad and deep bipartisan consensus on that point! :)




I criticize Obama, you say Republicans do it too, I say dammed right I agree. That doesn't invalidate the criticism of Obama. It seems to me fair to say that in many instances his behavior could be interpreted by some as to indicate that he sometimes finds the Constitution an annoyance and an inconvenience and would just as soon dispense with it and replace it with authoritarian rule. I'm not saying I necessarily agree with that totally, but you must admit he is very determined to implement his agenda. Some people are really happy about that. I don't mind his determination, I merely am uncomfortable with his methods.

The NLRB decides to ignore a Court order:

the National Labor Relations Board has declared that it doesn't like the D.C. Circuit Court of Appeals Friday ruling that three board members were illegally appointed so it plans to ignore it.

"The Board respectfully disagrees with today's decision and believes that the President's position in the matter will ultimately be upheld," Chairman Mark Pearce said in a statement. "It should be noted that this order applies to only one specific case, Noel Canning, and that similar questions have been raised in more than a dozen cases pending in other courts of appeals.

"In the meantime, the Board has important work to do. The parties who come to us seek and expect careful consideration and resolution of their cases, and for that reason, we will continue to perform our statutory duties and issue decisions."

Uhhh.... Anyone else look more than a day or two down the road to where they are going to be sued for every single ruling they make because the court ruled against the appointments? What happens when employers and unions choose to ignore their rulings like they are ignoring an appeals court ruling?

Presuming they get a stay pending appeal to either the full circuit or SCOTUS, they aren't doing anything wrong.

You know, they did tighten up fire codes nationwide after the Coconut Grove disaster in Boston. Of which I think one is that you can't just have revolving doors at the exit as bodies tend to stack up when people are panicking and running over each other. Since that 1942 fire, we've never seen anything in this country on that scale so something must have worked or we all got reaaaallly lucky since then.

According to the press, it did meet fire codes. Oh, and the rope that was used to hogtie Dr. Ketenuti, and the belt the was used to strangle her, also passed inspection. As did the lighter that was used to set her body on fire. How you gonna regulate belts and rope, genius?

Keep blaming inanimate objects for such and see how well it works out.

It's easier to "regulate" guns and ammo than it is to put money into mental health and such. No, that money is reserved for someone's bank account...just not yours.

PS - I don't own guns. And I don't support hunting.

Actually, there's a building in Troy NY that was not up to fire codes because you had to pull the door in order to get out (or at least there was no crash bar used to open the door and push out). There was a protest around a video game involving Middle Eastern terrorist organisations as art, and the police used the fire code as an excuse to bust the protest. This is why I'm talking about execution, because as much as you can regulate or ban until you're blue in the face, nothing will happen with it unless either lives are taken or it works to the government's advantage. If you look at the emergency telephones along I-87 in Essex County that broke because of Y2K, it's the same thing.
