There are a large chunk of young, healthy people who have thus far chosen not to buy health insurance, and there are a lot of old people with chronic and/or pre-existing conditions who have been unable to buy healthcare and have been made destitute by their health care bills. This law "takes" money from the young-uns and "gives" health insurance to the older folks - i.e. a wealth transfer.

BTW, now that this is a "tax" and not a penalty, Pres. Obama just officially reneged on his campaign promise of not increasing taxes on the middle class, only taxing "those who can afford to pay" again.

You jest, but I would go along with that plan. Young people who show up in the ER with no insurance = no care. Elderly people who would only have weeks or months of lousy quality life added by ridiculously expensive treatments = no care.

In order to do that, you'd have to shield all of the healthcare providers from lawsuits by the impacted patients / their families who would almost certainly sue for denial of care.

I think quite a few jest. I don't know if your wife was in a serious accident and wasn't given life saving treatment because there was screw up in insurance...that you'd be all thumbs up.

As with most issues, there should be a grey area here. Life saving procedures for who would otherwise be healthy is something I think we can find a solution for. Government sponsored hip replacements for a 70+ yo should not be.

That would never work. For old people, lack of care = assisted suicide and for young people lack of care = heartless and cruel
I'm sure some enterprising lawyer could argue that a right to health care is covered by the 8th Amendment protection from "cruel and unusual" punishment.

I'm in too good a mood to get into an argument today. I'm in joke-telling mode.

Of course. I assumed that went without saying - it's a sine qua non of denying care.

Meanwhile, Rand Paul is saying it doesn't matter what SCOTUS ruled, health care is still Unconstitutional. Also says 14th, 15th and 19th Amendments are Unconstitutional.

I especially like people who think the gubmint is going to come over their house and seize their possessions if they don't get insurance. The govt will merely reduce your deduction when you file your taxes hence no need to stop over for a visit. I mean, people DO realize this, right? Right?

Hey, when it comes to healthcare, we can all afford to pay more. Some of us will pay in cash, while others will pay in time. Waiting lines will get longer and longer for many many people, while concierge doctors will become more widespread. Some people will just pay the penalty and bypass insurance altogether, banding together to put personal physicians directly on their payrolls; others will start up private hospitals only for themselves and family.

Doctors nearing retirement will retire sooner rather than consent to all the additional paperwork, exacerbating an already difficult situation.

Barry One-Note is so insular in his thinking, the idea of "unintended consequences" never ever seems to occur to him...him being so much smarter than anyone else, and all.


Just because it's legal doesn't mean any of it will actually work.

that loophole will soon be closed, have no doubt. one thing that a democratic congress knows how to do is raise taxes!

No, it's TEH SOCIALISM!!! Jack-booted thugs are going to show up at your door and seize all your guns, then the IRS agents will come get the rest of your stuff! The Kenyan won't be happy until we're all living in huts and caves.

Correct me if I'm wrong but an amendment to the Constitution cannot be Unconstitutional.
