The Power of SCOTUS VIII redux: IX is being blocked by the Senate.

And so what happens if the GOP refuses to vote on a SCOTUS nominee indefinitely? What happens if they do the same in legislature? The Constitution breaks down. It doesn't work. The government functions of the Constitution. If you're endgame is we win or the US government (which is in essence the Constitution) fails, then you're no fan...because that's the likely outcome you've put on the table.

Reverse it if tD wins and Chuck controls the Senate. The endgame is to get to 9. It's not going to get to 9 under the current climate. Therefore compromise is needed.

Re: The Power of SCOTUS VIII redux: IX is being blocked by the Senate.

When the conduct of the GOP Congress has been normalized to the point that joecct is spouting this nonsense then it's basically over.

These guys are going to sabotage democracy any way they can.

The only way to beat them is to win and win big, then declare their voter suppression and gerrymandering unconstitutional, and move on.

Sometimes folks lose. The Slavers lost. It's long past time for the knucks to lose. Enough already. We have been hostage to the orcs for so long we accept it. Don't accept it. There are not enough of them to destroy our country unless we let them.

Kep - earlier I asked what you meant by a liberal Scalia. See the context a few posts back.

Because the Dems have ever refused to vote on someone? Because the Dems said, "The people should decide," and then when the people decide for the other party took their ball and left?

Fark your "both sides are bad bit," Joe. You hitched your wagon to a party in disarray, and you're still choosing party over country.

They've had the Senate for 4 years since Bill was president? The last 2 years of Bush43 and the first 2 of BHO. They haven't had a chance to enact gridlock. But since payback seems to be Chapter 1 of the legislative handbook, I expect no different from them when the Senate flips back.

Ike's Supremes were recess appointments (that were later confirmed by a Dem Senate). But that was generations ago where there were minimal differences in parties.

The Congre$$ is too polarized to function effectively. 6-10 Senators have to go and about 25 - 40 in the House to move the bell curve bubble more towards the middle.

A liberal Scalia would be a hardcore ideologue with a fig leaf judicial "theory" that she observes or discards by partisan whim.

I only insist upon this until the damage has been undone. Scalia served for 30 years, so in 2047 I'll accept giving the seat to an actual principled jurist.

Re: The Power of SCOTUS VIII redux: IX is being blocked by the Senate.

Yet the Missouri Compromise was used to admit Maine (free) and Missouri (slave) and established a geographical boundary on the expansion of slavery.

Jefferson hated it.

But it lowered the pressure in the cooker for a while, but hindsight showed it was imperfect.

Nothing is going to happen on SCOTUS as long as the Senate keeps being as divided now as it was in 1820.

Compromise is just that. You don't get everything you want, I don't get everything that I want, but we each come away with something palatable. Right now, there is no compromise.

So because the GOP refuses to their job the Dems should just bend over and give in? Sorry, you lost get the bleep over it.

The whole idea is stupid on its face and if it meant putting some pro choice justices on the Court you would be singing a different tune. And dont pretend otherwise joe...lying is a sin.

The level of ignorance and arrogance behind your post is actually rather staggering.

So let me get this straight...your side is ****ing on the very institution they hold so dear and everyone should buckle under? We dont negotiate with terrorists joe and I hate to tell you this but holding the Court hostage is just that.

One side is playing the game...stop pretending its "the political climate". It isnt, it is a bunch of crappy old white conservatives who cant stand their time is up. They played chicken and they lost...badly. They dont get to compromise now when 6 months ago they could have gotten a candidate they supported until the Big Bad Black Man put his name up for consideration and they said "NO COMPROMISE!!!".

This GOP position is cowardly as hell. That Joe is in full on defense mode of it is why he's been getting the Bob Gray treatment. I like Joe in general but this is just sad.

What should give undecideds or even those that seem willing to vote Trump to spite Hillary seem to ignore - which to me is the most vital characteristic - is his temperament. This seems to get pooh-poohed way too much compared with his comments about grabbing female genitalia as abhorrent as they are. While he’s a scumbag in that department it means far less to me than his potential for having a tantrum when he doesn’t get his way with a foreign diplomat. He has been a narcissistic bully so long he has no comprehension of tact, mediation, subtlety, etc. Can you imagine this ticking time bomb in a tête-à-tête with anyone that wouldn’t kiss his ***? He’s just salivating at the thought of using nukes in the way Junior needed to avenge Daddy by invading Iraq. And there’s a sh*t-ton of constituents begging for him to flex that muscle because they’re too myopic to consider life beyond their county (not country) border.

Perhaps the ship has sailed on his campaign and I needn’t worry, but then we’re going to be stuck with another 4 years of knuckle-draggers filling every minute with hateful rhetoric and they will never calm down. The “take my ball and go home” base has only become more emboldened during this run and I’m afraid it won’t go away. FOX News will go back to wasting every breath on criticizing Hillary after Trump himself fades and we’ll be back to where we were – with a significant portion of the country refusing to participate beyond Twitter, Facebook and hate radio.

It is that ability to compromise that the far right has risen up against, insisting that it will have no more of. That, to them, is business as usual and no longer tolerable in Washington. That's how the GOP got Trump as their candidate--by discarding anyone with ties to the standard way of doing business in Washington. Arguing "ability to compromise" might be convenient to you now, but the GOP has shown virtually no interest in it and has, in fact, made the exact opposite its rallying cry.

Dying parties typically turn inward and purge themselves to death. Because the hard core center holds that the ideology is sacred they can never adapt to a changing electorate. They retreat to the fantasy that they are losing ground because they aren't pure enough -- if only they get rid of the moderates then the country will recognize their moral superiority and come flooding back to them.

I don't believe the GOP will actually "die" -- it's too good a vehicle for enriching the 1% out of the public treasury. But they will need to change their cover story. It looks like they are headed towards Blut und Eisen, which should freak everybody out, especially limited government conservatives. If you think liberals like big government, just wait 'til you get a load of right wing fascism.

This was always going to be what happened if Hillary won. That's the core of the conservative grift: get the Deplorables infuriated by the Great Satan (whoever it needs to be: Obama, Clinton, Soros), then have a book ghostwritten or blather on the radio and watch the money pour in. That con won't end until the last knuck has parted with his last dollar. Then the Once-lers will pack up shop and move on.

It seems like the extremes of both parties insist that no compromise is possible. Some on the left even insist that no dialog is possible. ("shut up you xenophobic racist misogynist extremist! There's no point in listening to a single thing you might have to say.")

I'll never understand how my fellow lefties thinking I'm too hard on conservative posters jives with threads like this. ;) Aren't you all making the same argument that I usually do, or did it take this election to open your eyes? :D

The difference is the far right has taken over the GOP. Trust me, the far left can't even get a sniff of influence despite how well Bernie did.

In principle either could capture its national party. In practice, right now, it's the right that has the pox.

Obama tried dialogue, look what it got him. He had idiots yelling at him during the SOTU. The GOP is the cause of the current pollution.
