Jeff Flake has all but come out and acknowledged it's political and not principle as McConnell claims. Flake stated he'd be open to confirming Garland in the actual lame duck session if the Dems win the White House in order to avoid the new president picking someone more liberal.

At least he's being honest, which I'll give him kudos for.

That is how the GOP plans on winning. They argue the next President gets to choose, then if they lose they confirm the centrist guy Obama put up denying Hillary her opportunity if she wins to pick whoever she wants.

If Obama falls for it it's another case of him getting whipped by the GOP.

I was worried about this as well, but I seriously doubt the GOP Senate can hold introductory meetings (remember most won't even meet with Garland), have hearings which usually take a month, overcome a filibuster because someone like Ted Cruz will do so, and then hold a confirmation vote all while working around the Christmas recess, which lasts a month.

The only thing that gets this moving is if GOP Senators up for re-election start seeing their poll #'s threatened. Not going to matter for Kirk and Johnson who are already doomed, but if McCain and Grassley find themselves in tougher than expected races, principal will go out the window and save a ss mode will be fully implemented. Otherwise they just don't have time to get this done in the like 5 days they'll be in session after the election. :rolleyes:

It's good fun to see these guys wriggle on the hook they themselves dropped in the water.

All I know is based on what the GOP said if Hillary wins the election she should be able to nominate anyone she wants and that person if qualified should be confirmed without any problem. If that's not what happens then the GOP wins.

Garland could withdraw himself out of principle, saying he would be viewed as not having been confirmed on the merits, Obama could withdraw the nomination and say now that he really is a lame duck he must defer to the new president, or the Dems could booby trap the vote and join the GOP Obamahater dead-enders and vote him down, demanding a true liberal to undo Scalia's damage.

Garland is so well respected by many members of the GOP I don't see the issue you're ranting about. Also, the Dems will be meeting with him right now anyway. That part will be done. If Grassley (head of the committee) wants it done, it'll get done.

Are you kidding? Grassley has about as much sway over Teabaggers as I do. It'll take 14 Goopers to move this pick past a filibuster. I find it hard to believe they'll find more than the usual suspects (Murkowski, Kirk, Flake and Collins) to even do that. Then they have to find 10 more!

YES! You're imaging the Ted Cruz crowd as rational human beings. That's where your analysis is swirling the bowl Scooby. You will find 41 Republican senators to sustain a filibuster either because 1) they're nuts, and think they can do the same thing next year to a Hillary nominee because they're way smarter than the Dems who'll never get rid of the filibuster, or 2) they're not nuts but worried about their jobs if they vote to turn the SCOTUS over to the liberals.

How this plays out is the guy gets a few hearings after the election. Maybe, maybe, Itch moves for cloture and a vote, but people like Cruz have ZERO need to cooperate. Any Republican up for re-election in 2018 or 2020 is going to join him as they don't want to get primaried. Once that happens time will run out on the lame duck session. The existing GOP would do that in a second, anyway. Look at their record. Their Members are either cynical, insane, or both.

The GOP has shown that the system of minority protections doesn't work in the Senate if the minority are saboteurs. We're re-fighting the Civil War in the Congress. So far the Confederates have been using cannon and the Union has been using strong language. If Hillary wins then we have Schumer's march to the sea. This time there will be no Rutherford B. Hayes to cut Reconstruction short, because the Confederates are literally dying off. 150 years later we're finally going to drive a stake into The Cause.
