Re: The Power of SCOTUS VIII redux: IX is being blocked by the Senate.

You're the one who came up with the whole FBI and Central Bank thing. They may not have been involved with its creation, but why do you think Kennedy was murdered?

Because he was going to reorganize and restrict the CIA to prevent it from becoming a rogue agency.

The FBI are glorified beat cops. They're too dumb to come in out of the rain let alone assassinate a president. That takes the lads from Princeton.

Those of you that keep responding to Col. Flag(g) deserve everything you get.

"Nobody can get the truth out of me because even I don't know what it is. I keep myself in a constant state of utter confusion."

I like picturing the flow chart he has in his mind so he can perform these logical twists and false connections. Each flow ends with either "The Globalists," ""Bierbach Family (or whoever he kept saying)," or "Illuminati", and there's even a dotted line connecting the three.

I came up with the FBI and Central Bank thing? Uh, no, I was replying directly to what you wrote. Would you like to see the text again?

No, I said they both use plausible deniability. You decided to say they were directly related.

I love this quote, it says everything about conspiracy theorists (while saying nothing). Truly amused. FlagDUDE, what are your thoughts on "The Cathedral"? :)

Should have taken the Negative and gone to Sheol? No idea what you're talking about...

OK... I'm fairly certain I've already answered this indirectly at some point in previous posts. Religion is the world's oldest "community organizer" and "population controller". People can believe things are religions or cults all they want, that's their prerogative. To label it a religion as a means to attack it makes you no better than those you are labeling.

The most important point of freedom and liberty is tolerance. Actual tolerance. You can disagree and be PO'd with what someone says, but you respect and defend their liberty to do so.

Actually Scalia's deal with the devil came due, and he got called back to hell where he belongs! Flaggy does just want to report The Truth on this issue. :D

Re: The Power of SCOTUS VIII redux: IX is being blocked by the Senate.

Gilded Age II.

Yesterday, the House of Representatives passed a bill that could crippled the ability of government to regulate private industry.

The bill modifies the Administrative Procedure Act, which was passed in 1946, and represented a compromise between New Deal Democrats and free-market Republicans. It sanctioned the power of government agencies like the National Labor Relations Board or the Federal Communications Commission to regulate the private market, but required public hearings on proposed rulings and court suits to overturn regulations.

The Supreme Court ruled in 1984 that the courts could only overturn rulings that were “arbitrary and capricious, an abuse of discretion.” In other words, the courts would have to defer to the regulatory agencies in finding whether a ruling was justified. But the Republicans in the House passed a law that would allow the courts to rule without giving deference to the regulatory agencies. A Republican court could, for instance, overrule decisions of the Food and Drug Administration or the Environmental Protection Agency on concocted Constitutional grounds – say, by arguing that it violated the “takings” clause of the Constitution. That could cripple the regulatory agencies.

How about Senate Dems filibuster it?

Don't think they can. The filibuster is IINM whittled down to SCOTUS noms (for now) and budgetary measures.

I assume the GOP will just let er rip and completely end the cloture 60 requirement for everything. They might as well.

I've read that elsewhere and still am not sure it's as bad as portrayed. I'd like to see a more straight forward review of the bill.

Courts generally have de novo review on purely legal issues, like say the constitutionality of a given regulation. Unless this is purporting to strip the presumption of constitutionality (which itself isn't a great hurdle, it's akin to saying a tie goes to the agency), that part is nothing new.

If instead it means courts no longer have to give deference to factual findings of the agency, that's more problematic. Because the agency is the one holding the hearing and can better assess credibility of witnesses and the like.
