SCOTUS 12: Will Kavanaugh Be Confirmed?

Status

I know plenty of conservative lawyers...but that is neither here nor there. The ABA is not some flaming liberal organization or they wouldnt have backed Kavanaugh in the first place. (or Gorsuch)

I mean even Dersh is saying delay...he hasnt said a liberal thing since Trump got into office.
These ppl think the FBI is liberal.

Re: SCOTUS 12: Will Kavanaugh Be Confirmed?

Didn't Handy or Scoob or someone tell me yesterday that this is a job interview and not a court of law?

Better tell the ABA.

The American Bar Association has urged the Senate Judiciary Committee and the full Senate to slow down on the vote on Brett Kavanaugh ...

"We make this request because of the ABA's respect for the rule of law and due process under law," the ABA letter to committee leadership said.

"these people" you speak of are of course flaming hypocrites since just a few years ago, and for many years before that they thought the FBI was on a mission from God and was made up by nothing but holy people doing God's work. With every passing day I say that the republicans and self-identified "conservatives" can't get any more hypocritical. And then at the end of every passing day I ask myself how I could possibly be that naive.

I spoke with a union member yesterday, a parole officer, who asked why Kavanaugh would be lying about this, especially with all those women supporting him. I asked him to consider Bill Cosby's guilt or innocence and if there weren't plenty of women who were co-workers, colleagues or casual acquaintances of his who he did NOT sexually assault. I asked him to consider how many of his parolees who even after being convicted, serving time and being released still insisted THEY were innocent. Did he believe them? The guy twisted himself into so many knots I could have salted him and he would have looked like a giant human pretzel.

It is not a court of law, and the ABA said it.

Whats the matter Sicatoka...cant stand that even Dershowitz thinks this is a farce and they should delay? (btw I believe even HE said it wasnt a court of law)

But please...keep beating your dead horse cause it is all you have. At least Scooby is funny when he repeats himself. You...kinda sad :D

edit: From my post quoting the ABA:

"The basic principles that underscore the Senate's constitutional duty of advice and consent on federal judicial nominees require nothing less than a careful examination of the accusations and facts by the FBI," said Robert Carlson, president of the organization, in a Thursday night letter addressed to Senate Judiciary Chairman Chuck Grassley and ranking Democrat Dianne Feinstein.
"Each appointment to our nation's Highest Court (as with all others) is simply too important to rush to a vote," Carlson wrote. "Deciding to proceed without conducting additional investigation would not only have a lasting impact on the Senate's reputation, but it will also negatively affect the great trust necessary for the American people to have in the Supreme Court."

You know what isnt mentioned anywhere in there...COURT OF LAW! Nomination, advice and consent, examination, investigation...but never do they mention court of law. You know why...I will give you two guesses but you will only need one ;)

Keep digging and twisting. I deal with the concepts of due process and the rules of plenty of laws every single day in my job, and it is not a "court of law."

I just am looking for clarification between the ABA POV and what I was told yesterday about it being a job interview not a court of law. That's the twisting I'm looking to straighten out.

Found it ...
Again you're stuck on the court of law vs. the job interview. You still haven't gotten what actually is happening here.

On what planet do you have to be to think this is a court of law? Numerous Senators yesterday stated during the hearing that it wasn't. Are they wrong? Common sense tells me it is not.

The ABA asked for "respect for the rule of law and due process under law". Yeah. But I was told yesterday this is a Senate action, not a court. Those items are court proceedings.

And if they do delay it'll make Lindsey Graham right. And that's a terrible conundrum.

I say delay. And when the FBI finds all that we know now, and nothing more?

Amy Coney Barrett will continue to smile. No way in < bleep > is the next nominee male.

Then why is the ABA asking the Senate to follow the processes used in courts of law? Are they asking the Senate to change their "job interview" (your phrase) process?

Re: SCOTUS 12: Will Kavanaugh Be Confirmed?

Didn't see the original comments, but it really was a job interview. Senators have no justice powers. However, a legalistic approach was best to determine whether the candidate is morally qualified. And of course, there are legal ramifications of the events which they discussed.

Re: SCOTUS 12: Will Kavanaugh Be Confirmed?

Due process applies to all government functions, not just court proceedings.

Nice try, though.

So the Senate isn't following their job interview process. If they're not, they're screwing up. If they are, sometimes the process stinks and doesn't go in your favor.

They're not required to. And, any Senator can vote any way they want to at any time. They're not bound to vote yes or no based on any fact they may have heard.

Hey look, it's someone who isn't a lawyer but stayed at a Holiday Inn Express last night!

Facts and process don't matter. The US Senate process is arbitrary and capricious. Fan-tastic.

Funny how you weren't this concerned when they didn't vote on Garland for over a year.
