Yep. Never understood why Dem voters don't care about SCOTUS.

I actually have a theory on this. I'm sure I'll get shouted down by a few here, but I have a decent amount of confidence in this theory.

My theory is that the Dems have used the "sky is falling" ploy with respect to justices too often, and for too long, and a sizable enough segment of the base of the left have become a little too blase about it.

Since Bork's nomination 30 years ago all we have ever been told by left leaning politicians with each appointment during a Republican administration is that the end of the world as we know it is nigh. Basically it mirrors what has been written in this thread this afternoon.

But notwithstanding these dire warnings, the end has not occurred. Abortion is still legal. Gay marriage has received constitutional protection from the Court. Obamacare was upheld.

Justices who are appointed never turn out to be more conservative than everyone assumes. Sometimes they turn out to be exactly as conservative as we guess they'll be, but more often than not they turn out to be more liberal than anyone anticipated, or start drifting in that direction over the course of their careers.

You'd be hard pressed to identify a justice who was appointed as a liberal and turned into Alito or Scalia.

I always wonder about this. Is it really the justices getting more liberal, or that they get loathe to overturn themselves? It's easy to come in as a firebrand and overturn things your predecessors wrote. It's less easy to continue to throw fire 10 years later when people are asking you overturn yourself.

That might be it, but I’m not sure I entirely undersnd what you mean by overturn themselves. Do you mean precedent? Or their own personal votes? Because I’m not sure why that would mean they get more liberal.

Aside from your thoughts, the other thing I’ve wondered about is how we determine the judges are shifting or the baseline is shifting. Easier to move Planet Express Ship or the Universe?

Chris Matthews was adamant that they have to stop it or the Democrats will lose their entire base over it. I don't think the base understands what has happened and why the Democrats have no power at all to stop this right now. Interesting that Chris Matthews doesn't get it. Hell, Heidi Heitkamp and Joe Manchin might vote for the nominee regardless of what position the Democrats take.

Chris Matthews needs to get his head out of his a ss. There is no mechanism for the Dems to stop a GOP SCOTUS nominee. None. Zip. Nada. So Matthews wants to base to punish them over something they have no actual leverage over? No wonder people sit out elections. :rolleyes:

Keep hoping for Flake and Collins to do the right thing. I just don't see that happening. At all.

People may want to sugar coat this, but there's no sugar to be had. I think I saw a Lily Tomlin quote on kos sayings "Its going to get a lot worse before it gets worse". Sounds about right. :eek: ;)

PS - If you want a laugh, its open season on the "there's no difference between the parties" lefties in the comments on the daily kos site!

That's true. But then could you at least acknowledge that the justification the right used two years ago to keep Scalia's seat empty has been proven now to have been bull****? Not that it wasn't obvious already. Also, you can say you don't have a party affiliation, but when you're openly waiving the pom poms over this, you're not fooling anyone.

Obama's party did not have the votes. What do you not understand about what I said?
 
I responded "that's true" to what you said, thus indicating my understanding. I then posed a related but separate question. Understand?

So he's throwing McConnell's words at him...do you think McConnell will care?
