Yeah, it's a matter of public record. It has to be. The point of recording deeds and mortgages is to give notice to the world as to who might have an interest so that a buyer doesn't get swindled (at least with respect to ownership.) The public record will show you the mortgage and any other liens, but it won't necessarily show you what is currently owed.

Oh, that's interesting. So then you would have to do due diligence and demand that information if you were deliberating about a transaction, when Dump say claims to be 99% of the way through paying back a $300M loan and it turns out he hasn't paid a penny?

I would think that the public record might as well go farther and show that, too, but I guess then it becomes too onerous for record keeping and status. This way you give the party the flashlight and point it, anyway.

You think they are mortgaged to the hilt? Is that a matter of public record? Or in his taxes?

Before he started selling American national security to the Russians he had to have some collateral for his Deutche Bank loans.

To New York City and State, that really doesn't matter- the value of them is still the value- seize them and sell them for billions. Or at least hundreds of millions. Let the debtors deal with dumpy.

NY actually has a pretty good online site. The link is below. It's a little cumbersome until you figure out how to use it, but it only took me like five minutes.

I looked up a couple of the properties listed in that article you linked, and the properties show up as owned by limited liability companies that a quick google search reveals are connected to Trump. However, you also see things like UCC liens granted to various banks, which suggests that these properties maybe aren't mortgaged, but there are UCC liens that exist with respect to them.

If you want to see how it works, follow these steps:

1. Click on blue button that says "Begin Using Acris"
2. Click "Find Addresses and Parcels"
3. Under the property address section, use the drop down to select Manhattan, then "4" under street number a "East 57th" under street name
4. Click "Find BBL" just above the "Main Options" button
5. Click "Document Search by BBL" to the right of the "Find BBL" button
6. Click "Search" on the new page

You are now in. There are two pages of entries, with the most recent ones on the first page that pops up. In this case it's a UCC continuation document. You can switch pages by using "previous" and "next".

You'll see that in December of 1995 the company granted an assignment of leases and rents to a bank. If you want to see the document itself, click on "IMG" in the left column.

I don't think it quite works that way.

If you owe real estate taxes on a property and don't pay them, that tax lien may become a "super lien" that will take precedent over things like mortgages. That's why most mortgages insist you pay your taxes as a condition of the mortgage, so the first time you don't the bank can step in and see that their interest in the property isn't lost.

However, if NYC or the state is owed for something like personal income taxes or anything like that, and they end up with a judgment against Trump, there are a couple of issues. In a lot of places, judgment liens don't get any sort of priority over earlier judgment liens or mortgages or anything like that. Second, if it's Trump that owes the taxes that are reduced to a judgment, but the real estate is held by an LLC or a corporation or another entity, the government can't just come in and seize that property and sell it. They have a right to take Trump's interest in it, which might include things like dividends or distributions from the company. But the LLC doesn't owe the judgment, Trump individually does.
