As I understood it he already had a military slush fund he could use without declaring a national emergency. Instead, he did the stupidest thing possible.

Personally I hope the dems fund their emergencies by taxing the living hell out of churches

Doesn't the declaration of national emergency give him the power to shift money that was budgeted elsewhere towards funding for the wall? So, tell me about the shift to fund the green new deal, UBI, single payer health insurance and new infrastructure. Will probably take a little bit more than say the money allocated for congressional junkets.

I do believe there are limits in how the money shifts can be performed, but I'm unsure of exactly what those restrictions are.

Either way, it's a horrible idea and no side should be excited by it or the possible downstream ramifications.

Sure. But that's partly my point. If a President wants to find $4-5 billion, no big deal. He can find it easily. But the wish list that lefties are now ejaculating over that they think they'll get in January 2021 is going to be a slightly bigger shift of funds.

It is a stupid idea. It shouldn't be done, unless there are real emergencies.

But declaring national emergencies doesn't install full dictatorial powers on the president like some here and elsewhere seem to suggest, the power to just levy taxes at will and spend whatever amount of money he or she wants.

In any event, if he declares a national emergency, Nancy gets to hold a vote in Congress as to whether that emergency continues.

It's ignoring another piece of the Constitution for "I wanna I wanna I wanna!"

It's the precedent from “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law" to ¯\_(ツ)_/¯

If that's something that can be ignored for a (self created) emergency what isn't? You give politicians a tool, they'll use it.

So are you suggesting that what dumpy is doing is ok, and the things the D's want to do is not?

As far as I can see, national health care IS a national emergency- unlike the theoretical people harmed by immigrants, the fact that we don't have national healthcare is clearly leading to more early deaths- our life expectancy has dropped, and is going in the opposite direction to other developed countries.

Poverty, for sure, causes premature death. So there's a national emergency. Direct funds there.

Climate change kills people- ask people recovering from hurricanes or fires... direct funds there.

And guns kill people- more people are killed by guns than immigrants. Direct funds to deal with that.

BTW, watching the replay of Maddow last night, the whole Russia thing is getting deeper and deeper. The pattern is consistent that Mueller is winning at every point. Mueller, a long time Republican, one should note.

And for the haters, don't forget that many of these people said in a court of law that they did break the law. Including Manafort. He's just dumb enough to violate his agreement, so it's likely he will spend the rest of his life in jail. Or dumpy will let him go, which means he'll have to head to russia to get asylum.

So don't forget the bigger picture. There is a russian agent behind all of this.

I'd imagine Pelosi will do the vote to end the emergency first and when McConnell sits and spins on it then people and states with standing will start filing lawsuits. Hopefully it gets bogged down and Trump is voted out before the Supreme Court rules on it because I don't trust them not to narrowly hand Trump a win like Bush v. Gore where "it only applies here"

Does a court of law get a chance to review the alleged factual basis of a declaration of emergency, as opposed to the constitutional authority to use if for its stated purpose? I have to think Dems would welcome a review of the factual basis, assuming that would occur in federal district court.
