I amended it, because I was talking about the "in my opinion" case. In my ideal state, there's a temp insanity defense, he qualifies, and he walks. But since that was confusing I changed it to Texas -- if he won on temp insanity I'm fine with it, and if he won on lack of evidence... well, I don't love it exactly, but Im unclear on if/when/why temporary insanity was struck down. Isn't that a recognized part of law that you can indeed lose your head with the right provocation?

Nope. Did get accosted by the pro-life people handing out rubber fetuses (fetii?) though.

The Greek (argh, Latin) was foetus/foeti. I dunno what happens when we change a loan word -- does it lose its provenance? Cool etymological question.

Edit: Wikipedia says foetuses. I guess once you're English, you're English.

But I may also just be bitter after working at a booth at the state fair for 16 hours last week and dealing with (ie ignoring with as much politeness I could muster) lots of...interesting...rants.

To be fair, most of your more colorful visitors probably have nothing to look at except corn for 7-8 months out of the year, and dead/plowed over cornstalks for the other 4-5. I'd go insane too.

I recently moved back to a rich, white Republican suburb, and it's no longer feeling icky. That is how it starts, then you get all worked up over Priceless being facetious, next thing you know you're arguing that tax cuts are the best way to stimulate the economy, attending church again, and from there it's just one more step to being "that guy" standing on popular street corners at with revolting, bloody photos of abortions. Help me! Before it's too late! :p

I feel there's nothing to discuss here. If the guy wins on temporary insanity, it is a recognized defense. If he wins on lack of evidence, well, sure texas, whatever you need to do I guess. But if he tossed the gun in the ocean after recovering his wits then he should go up on the lesser charge of whatever destroying the evidence is. I don't see the problem.

This is one of those cases where people are so wound around they own sphincters they just jump to conclusions about what the guys typically on the other side of the fence are saying.

Fair enough.

Texting while driving in ND is illegal.

I'd guess this 20-year-old's "I wasn't texting, I was on Facebook!" excuse might not work out so well for her:

Hillsboro (KFGO-AM) -- An arrest warrant has been issued for a Hatton woman involved in a fatal crash on I-29 near Hillsboro in May.

Traill County authorities want 20-year-old Abby Sletten for negligent homicide.

Sletten is accused of using Facebook on her cell phone when she rear ended a vehicle, killing a passenger, 89-year-old Phyllis Gordon of Ada.

Three others were hurt.

I personally am getting a kick out of the legal arguments being made by non attorneys. Especially since I'm betting none of us live in Texas or have the slightest idea what Texas law is regarding various defenses/mitigating factors.

But I'm sure someone stayed at a holiday inn express last night.

Why not send out some bills?

If the drunk driver left family behind, are they now free to kill the man who killed their loved one? (assuming they throw the gun in the ocean)

That's why we generally try to have these matters tended to by people without a dog in the hunt. About a decade ago a woman named Ellie Nessler got a great deal of favorable coverage because she murdered the man accused of sexually assaulting her son. . .in open court, during his trial. There were quite a few people who thought that was okay. And they didn't consider the green light their approval would give to the defendant's surviving family.

As to the Texas case, there has been quite a bit of chin music about the insanity defense. Just as there was about "stand your ground" in the Trayvon Martin shooting. However, since those defenses weren't offered in either of those cases, what's the point? In Texas, prosecutors may have thought that the father had killed the drunk driver, but they couldn't prove it. Why is that in any way remarkable? Guilt beyond a reasonable doubt is the universal standard in criminal trals. Similarly, in the Martin shooting, "stand your ground" was never an issue, since you're always allowed to defend yourself from a guy banging your head on the sidewalk.

You know why you brought up the jaywalking, we all do. Despite the fact that it literally happens everyday in every major city and is hardly an issue, it's extremely relevant here because he brought attention to himself.

Why is saying that you might have a mental illness an insult? Robin Williams had a mental illness. Are you saying people with mental illnesses are less of a person than a "normal" person? That's rather sad, if you ask me.

I did imply you might have a mental illness. You took it as an insult. Why is that? Is a person with a mental illness "less" of a normal person? Again, I ask you this.

If you don't have one, I can only assume you are dense enough to not have any common sense, as you refuse to acknowledge basic facts that have been proven, yet you try and dis-prove.
