I think you need to reread the Constitution...

You know, I actually thought the same thing about a "Congress shall make no law" phrase, so I read it again before posting it, and there's nothing in there stating it doesn't apply to private entities. I can understand why some would feel that way because of the phrase about a warrant, though.

Usually in the US authorities needs a court order to do something like that, as the Fourth Amendment of the Constitution guards against unreasonable searches and seizures. But Capital One claims it has the right to get up close and personal anytime, anywhere.

However, Daniel E. Kann, a Santa Clarita lawyer who specializes in illegal-search cases explained that the amendment applies primarily to searches and seizures, not civilians, and theoretically the bank may reserve the right to pay a visit to your office or home without applying to the police.

"It sounds really invasive, but I don't think it's a violation of your Fourth Amendment rights," Kann said.

If you sign a contract to allow it, it's not a violation of anything other than your trust. It's also a sign to be thankful I'm not a Capital One client and will not be at anytime in the near future.

I can't see how the bank is saying anything other than, "we might someday drive on a public road, park our car, and then take a walk along a public sidewalk and up your un-gated walkway to your public-facing door and knock on it, just as any other person in society would be free to do." There's nothing that says you have to answer the door or let them in. If you ask them to leave and they don't, then you'd still be able to call the cops to report a trespasser.

I don't really think it's fair to assume the firefighters ordered from there because they knew it would be free. It's also not fair to assume that the reasoning was fake (though it's possible...both sides have incentive to lie here), or that she was doing it because she thought they were underpaid. Believe it or not, some people like to do nice things for first responders to be nice and thank them for the work they do.

The first group may not have, but the second one sure did.
